      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Can I ask what contact number you phoned as I am getting nowhere with them , sent a letter recorded delivery asking for my membership to be cancelled asap and my money refunded just like they asked when I phoned the complaining, emailed them yesterday enquiring them to confirm that my account was cancelled and my money would be refunded,, today I got one of their standard emails back going on about how I signed up to this membership and what benefits I would get from been with them.

the more this goes on the more angrier I get, I am a single mother and this was my child benefit money they took, they left me & my daughter £14.00 to live on.

 

I just cant beleive they can get away with this, they are not even licensed by the OFT, surely this is a criminal act in itself?

 

Sorry for going on , but soooo angry, any help you can share with me would be appreciated.

Hi all i have also been hit by this EPM they took a paymnt of £70 for some reason i do not know but then two days later i went to the shop and went to pay by card and it was declined and i knew i had funds in there so i want home and phoned my bank and had a big awakenin when i found out the this EPM had cleared my account with a payment of £12995 so a total of £13065 i have tryed to contact the company but all i get through to is reseption im also in contact with my solicator and my bank and no one can explain why they have taken this amount for something i have never applied for.they also mentioned that the purchase peoples information from companies that have declined people and the only ones i have used is WONGA and QUICKQUID.i will keep you all updated hopfully all will be resolved.

hmmm... well I also went to FLM loans at the time as appreared there could be a connection round the same time (received paperwork for guantors loans as this company seems to have rec'd my details) just as the 1st weird transaction was taken, but even they couldn't believe the odd amount I had taken could be a 'brokers fee' - FYI

 

Think I saw on here someone kind of boasting they had got away as their account was empty so couldn't be debited - would like to stress whoever is behind it will keep trying to obtain the funds in couple of months time if you still have same bank acc - your details likely to be distributed to ccbilleu.com of Vallenta (whom are outside of the UK)

 

Oh man, regardless these people need stopping

Going to try Watchdog again ! now they have new series!

 

Will update with anything more I can gain - if it helps someone avoid this and helps others in the mystery, that is my main aim

I've just had the same experience only there was not enough money in my account for them to take it. I was looking for a loan which I decided not to take. That might have something to do with it. Goioing to continue to search on line until I find them.

 

 

@ Ita , be careful you may find they may try again in a couple of months even -

the only guarantee is changing your bank account

Just to let you guys know I checked my bank account today and Power Loans have refunded me the money in full, I have just transferred it into my other account where my wage goes into so they dont get a chance to take it back, there is now no money in the acount that they have details for so hopefully that will be the end of it until I can pay my overdraft of in full and close the account.

 

Thanks for all your help & i sincerely hope you all get your money back too.

Hi GuysThis is the second time this month that money has been taken from my account, with the amount today being EPM £69.75. Natwest have been absolutely brilliant and as soon as the payment has gone through they will credit the money back to my account. What i did find out is even if you cancel your card and order another one, they have a way around this by stating that the payment is money owed and can still take money from your account. The only way to stop this is to open a new account with new details. i would also recommend that if you want to use the internet in the future for purchases invest in a pre-paid credit card and dont give out your bank account details, we have all been affected and need to make sure this stops. I am more than willing to get involved and make sure this doent happen to anyone else.Tracy x

hiya i have just been trying to sort out a payment they took from my brother who is 17 and never authorised any payments i phoned the company and they just gave me excuses i got a website though which is powerloans.com this is the company that is doing it no luck in getting the money back though good luck all x

i just had a telephone call from santander saying that epm power attempted on 2 occasions in the last 2 months to take £67 from me. they are sending me out a new card, they seemed to know this company is attempting to take money without permission as the lady commented this has happened to a few people.

They are a broker that gives the impression that they are a lender.

 

If you have searched online for a loan, through wonga and many other payday companies and have entered personal and bank details, they will send all of your details inluding bank details to powerloans.com. Power Loans will then take a fee out of your bank account.

 

I know this company very well. Do not waste your money phoning your bank up, this will only result in a high phone bill, they will not refund you because you have voluntary gave your card details over the internet.

 

As soon as you realise you have had the money taken from your bank account you must write to:

 

Power Funding

1 Liverpool Street

London

EC2M 7QD

 

Request a full refund however you must do this within 2 weeks of money going out of your bank accoun,t for you to get a refund back quickly as possible

 

They are obliged by law to refund any money within 14 days of money been taken from account.

 

You must state in the letter :

 

 

 

 

 

 

  • Your details was passed on through another company therefore you did not consent to the money been taken out of your account.

  • That you will seek legal advice and contact the financial ombudsman if they do not co - operate and issue a full refund.

Once they receive the letter, it can take upto 14 working days, from them receiving the letter for them to transfer money back into your bank account.

 

 

If for any reason they do not co - operate with you, have a look at financial ombudsman website, they have legal powers to force Power Loans to refund all the money taken from your account.

6.1Under the financial services (distance marketing) regulations 2004 a Member may terminate or cancel their membership within 14 days of inception by (6.1.1) Requesting cancellation in writing to the following address: Power-Loans.com, 1 Liverpool Street, London, EC2M 7QD.

In your request please include;

• Name & Address

• Email Address

• Membership Fee

 

Upon receipt of your request we will fully process your cancellation and refund the initial membership fee within 14 days.

Liquid Advance is on of the culprits behind this - if you fill in their application form - they redirect you to another website called my-payday.co.uk - both are set up to appear as lenders when in fact they brokers - a redirection page pops up asking you to enter your card details. I've just had a crazy call with Santander - apparently their customer agent I just spoke to reckons that once you enter your card details into a website that constitutes consent to the company to take the money from you! I'm watching my account like crazy as these theives aren't getting my money.

Hi, I had the same company take this amount from bank on Saturday!!! I phoned the fraud team at my bank and they are refunding my account tomorrow. Your bank have to refund this as it's Internet fraud. I would phone them again and demand a refund. The bank are updating me when they get to the bottom of it. I'll let u know when I hear anything. You should also get ur debit card cancelled. Hope u get ur money back soon.

I had a debit from my account today £69.75 and bank charge for going over my overdraft... by `epm power-search.b` aka power-loans.com so googled it and came to this page (hello) and thanks for all the good advice. I didnt sign up with them either, think I did `payday loans`

 

I phoned power-loans this morning who gave a lot of spiel about how I had signed up and was a now a member and said to write within 14 days (of money debiting your account is this? ) They have to close your `membership` and refund within 14 days after that I think.

My bank says that`s a waste of time - to send the letter anyway - just so they have it that you want out of their t`s & c `s.

My bank (co-operative) says its not fraud as you have entered your acc / bank details - you DONT need to change your bank acc / card - with all the resulting hassle - you should to contact `visa (or whichever card) DISPUTE department` who will stop further payments from company or affiliates going out (without need to change anything)

so Im sending letters to power-loans (or whatever they`re called) my banks dispute dept. and the financial ombudsman.

On a personal note, I am a single mother too and we`ve had only the scrapings from the cupboard for days as this was my food budget for the week they took. It is sick how they target those most in need !

And the same thing has happened to me. I rang my bank but they were very unhelpful. So am going to go into tomorrow and talk to someone. whilst literally crying into my cup of tea because i havent got a penny for my daughters food and nappies, the cheeky buggers sent me a text saying my membership was agreed or something. At the end of the text message was their number so i rang theml and the bloke on the phone tried telling me that i had agreed to it all by clicking on their term and conditions. I told him in a choice of words i cannot repeat on here as i am a lady when not angry that why would i pay such a high fee to see if i could get a loan, i dont want a loan and i want the money refunded back into my account NOW! he said i could write to them by post or email but i had to give him further details about my financial status before he could give me the address. I completely lost it with him and said i dont have to give him any more details and that by right he has to give me the addresses i require to get my money back which he did and was still giving me the sales pitch to which point i told him Sod off and put phone down!! i have now emailed the company and sending a letter to get my money back. By the way i never went on their website i must have been transfered from another.

 

i better get my money back because the worst thing they can do is mess with a heavily pregnant woman.

I think I have just beaten them!!!! I called there number 08447049707, first you have to pass data protection act otherwise they will not talk to you! So I gave my details and asked that they remove my number name and bank details which they did straight away, (they have to do this and they did) then I asked for the managers name which is a Steve James, (there is also a call centre operative called John griffs

I have just checked my online banking and seen a payment from a company called EPM Power-Funding for £69.95. I have no knowledge of this company and contacted my bank to get this debt card payment refunded as i didnt authorise it. I was told i have to contact them direct as the bank cannot help, they couldnt give me a telephone number but did tell me they are based in the USA.

 

I have looked online for such a company but have had no joy, could someone please help me as im concerned they could take more payments as and when they like and i have no defence to stop them?

Strange .. I was with the Co-op bank too when it happened to me earlier this year - after waiting a long time for the funds back the bank then scared me in to changing banks which ended up a better move for me anyway now, they did use the it's a re-occuring payment so we can't stop it!!! not that it worried them they couldn't see or provide anything to back these mysterious payments up to!

They also didn't bother to put a 'stop' on card 2 or 3! re-issued new cards but didn't think to close of the ones issued before !!! doh oh yes!!! I love paying random companies for nothing!

Glad to see they have actually changed their policy then!

I firts heard of them when I got a automated call from Barclays about the transaction that had just been made on My account. It had a debit of the same amount £69.77 twice and put my account into a negative balance where my account has been charged more bank fee's on top of the fraudulent debits. I wasn't refunded my money the first time cause the bank said that they never received the fraud documents

Thankfully i found this post to see that i am not the only one here.

The company is Power-Loans.com and looks like they sold my details to brokers all over as i have been inundated with texts and calls etc.

 

I have had the same thing happen to me, possibly some payday loan enquiry that i can't recall. They debited £69.75 and another company loanfinder.co.uk. took £67.87!!!!

I called EPN and got the manger(some stern unsypmathetic woman) to return my call after them stating i have to write to them! but it takes a click or a visit to their site for them to obtain the money from me!

I stressed that it had been obtained fraudulently. So i have to write to them at :- Power-Loans.com 1 Liverpool Street, London, EC2M 7QD., state name, contact number,email address, and last four digits of account number on card, the amount the took and importantly your signature.

They said they will refund in 7-10 days so watch this space...... Still sourcing info on powerloans.co.uk , could only find an email address.

 

These companies prey on people genuinly at a loss and at a low ebb to look for some financial help when they have no where else to turn.

The last thing you would expect is for them to take money from you !!!!!

 

I do hope that others can re-claim and get what is theres back, how these companies operate is ruthless.

Update , went onto loanfinder.co.uk website, requested username etc then to cancel section, there is an option to refund the money debited. it takes 7-14 days.

watch this space. i am seriously considering cancelling my bank account and setting up another.

Im so glad many of you are finding this thread useful. Thats why I started it. Sorry so not being on here for a while but Ive been very busy at work.

 

Update on my Watchdog contact, (if you read earlier posts you will know about this), Im still trying to get more info together in order to forward it, this is nearly done and feel that with the number on posts here, and people effected by these monkeys, it would certainly be in their interests to view/contact them and challenge companies like this, certainly make more people in general aware of the dangers of these types of companies taking money for the poor and in need.

 

geoffb377 my advice to you is open a new account and you have totally peace of mind that this company have no way whats so ever, to take more money from you.

 

It has been reported that they can keep your details, then months later, bang you for another £70 odd.

 

If any one else has had issues or stories, please write and add to thread, more stories and advice given maybe we can help loads of others in getting their money back.
