    • aha  i thought it might just be whats called a summary debt, i had a few of these over the years.   in this instance B&S are simply operating as totally powerless debt collectors you are safe to ignore them.    
    • Well this is an excellent disclosure. It makes it clear that they have no idea of the timeframe. They talk about misuse – which is clear that it must've been misused and of course importantly they make it clear that the failure of the clutch plate would have been sudden. Well that's to be expected but also it suggests that there was no reason for you to suspect anything until he actually went. I suppose that it's a bit like dying. You can have an illness for weeks but the very moment of death is going to be sudden. One second you're alive – the next second you're dead. I think the information you have here doesn't prove anything for them at all and of course it would be for them to prove their case – not for you to disprove it. Very interesting that they're not able to get the clutch condition report. It's amazing that it wasn't uploaded and that they sent the sole copy to this person "Chris Ward". I wonder who that person is. Anyway, even more, I think that there is no particular reason to worry even if they pick it up again and start to chase you – which I suppose is fairly likely

    • I received a SAR from BVRLA and it includes an email trail with Hertz about my case. Few points I noticed:   [...] This is the only image we have of the clutch. The clutch condition report unfortunately was not uploaded to the job because it was sent to Chris Ward who is currently on furlough.   But as you can see from the condition of the clutch cover and the lining on the friction plate it has been shredded off the rivets of the plate. This kind of damage would not occur under normal driving conditions. [...] Concluding summary statement based upon cause of failure. Reference should be made to the time frame in which the damage / failure occurred   It is likely that the clutch has been misused but it is not possible to provide a time frame. The final failure of the clutch drive plate is likely to have been sudden. [...]   I asked, together with the SAR, a detailed report of the van before I rented it but I didn't get any response (yet).
    • Hi, basically I booked a return ticket on Eurostar for last August, due to the pandemic I obviously cancelled and, fair play to Eurostar, they sent me a voucher for the full amount within 24hrs.   The vouchers are valid for a year, however upon reflection, I can't see me using them now any time soon, so would rather have the cash.    Would it be possible to use the vouchers today to book a single journey to the full amount, £115 (or perhaps to a slightly greater amount using cash, say £130), wait a few days, then cancel the ticket again but this time demand a cash refund?   I've looked at the Eurostar T&C's and can't find a definitive answer. What do you all think? All opinions welcome.   Ta.

    • I came across this discussion recently and just wanted to give my experience of A Shade Greener that may help others regarding their boiler finance agreement.
       
      We had a 10yr  finance contract for a boiler fitted July 2015.
       
      After a summer of discontent with ASG I discovered that if you have paid HALF the agreement or more you can legally return the boiler to them at no cost to yourself. I've just returned mine the feeling is liberating.
       
      It all started mid summer during lockdown when they refused to service our boiler because we didn't have a loft ladder or flooring installed despite the fact AS installed the boiler. and had previosuly serviced it without issue for 4yrs. After consulting with an independent installer I was informed that if this was the case then ASG had breached building regulations,  this was duly reported to Gas Safe to investigate and even then ASG refused to accept blame and repeatedly said it was my problem. Anyway Gas Safe found them in breach of building regs and a compromise was reached.
       
      A month later and ASG attended to service our boiler but in the process left the boiler unusuable as it kept losing pressure not to mention they had damaged the filling loop in the process which they said was my responsibilty not theres and would charge me to repair, so generous of them! Soon after reporting the fault I got a letter stating it was time we arranged a powerflush on our heating system which they make you do after 5 years even though there's nothing in the contract that states this. Coincidence?
       
      After a few heated exchanges with ASG (pardon the pun) I decided to pull the plug and cancel our agreement.
       
      The boiler was removed and replaced by a reputable installer,  and the old boiler was returned to ASG thus ending our contract with them. What's mad is I saved in excess of £1000 in the long run and got a new boiler with a brand new 12yr warranty. 
       
      You only have to look at TrustPilot to get an idea of what this company is like.

    • Dazza a few months ago I discovered a good friend of mine who had ten debts with cards and catalogues which he was slavishly paying off at detriment to his own family quality of life, and I mean hardship, not just absence of second holidays or flat screen TV's.
       
      I wrote to all his creditors asking for supporting documents and not one could provide any material that would allow them to enforce the debt.
       
      As a result he stopped paying and they have been unable to do anything, one even admitted it was unenforceable.
       
      If circumstances have got to the point where you are finding it unmanageable you must ask yourself why you feel the need to pay.  I guarantee you that these companies have built bad debt into their business model and no one over there is losing any sleep over your debt to them!  They will see you as a victim and cash cow and they will be reluctant to discuss final offers, only ways to keep you paying with threats of court action or seizing your assets if you have any.
       
      They are not your friends and you owe them no loyalty or moral duty, that must remain only for yourself and your family.
       
      If it was me I would send them all a CCA request.   I would bet that not one will provide the correct response and you can quite legally stop paying them until such time as they do provide a response.   Even when they do you should check back here as they mostly send dodgy photo copies or generic rubbish that has no connection with your supposed debt.
       
      The money you are paying them should, as far as you are able, be put to a savings account for yourself and as a means of paying of one of these fleecers should they ever manage to get to to the point of a successful court judgement.  After six years they will not be able to start court action and that money will then become yours.
       
      They will of course pursue you for the funds and pass your file around various departments of their business and out to third parties.
       
      Your response is that you should treat it as a hobby.  I have numerous files of correspondence each faithfully organised showing the various letters from different DCA;s , solicitors etc with a mix of threats, inducements and offers.   It is like my stamp collection and I show it to anyone who is interested!

Hi all... i'm currently having problems with Lowell regarding a Capital one account i opened in 2001 , they purchased the debt in 2006 and have been chasing me since , it got to a point last year i got so fed up i gave in to there constant phone calls and threatening letters and set up a DD with them , i know now that was pretty stupid without seeing proof and after coming across this site i have stopped payments and sent a CCA request then the follow up letter, a month or so has passed and they have now sent me what seems to be an Application Form for the credit card?? is this ok?? what do i do next?? thanks in advance :)

Welcome to CAG.

 

With Cap1 I bet there's a lot of charges on there that you could claim back. Possibly ppi as well.

 

Do you have all of the statements for the account?

 

Claiming these would reduce the debt.

 

Can you tell us what your desired outcome is?

hi... i don't have any statements what so ever i binned everything years ago, could this be statue barred or have i blown that by setting up a dd with them feb last year??

 

And also is the document they sent me an enforsable CCA ??

 

At present my financial situation is bleak so to get these cretins off my back would be a godsend!!

Hi

 

If a debt has not been acknowledged in writing or a payment made onthe account in 6 years (5 in Scotland) it is Stat Barred. By making payments the clock has reset sadly.

 

Lowlife buy these debts from Cap1 for peanuts....Cap1 would have written it off against tax a long time ago and so any money the dca (Lowlife) can get in is profit straight into their pockets.

 

I wouldn't rely on un-en paperwork. The reasons are discussed in another thread in the Debt Collection forum. Take a look here...

What I would do is send a Subject Access Request to Cap 1. This will yield (amongst other things) a transaction history on the account which will reveal all the late payment fees and over limit fees applied to the account. It will also reveal whether ppi was applied to the account. There is a template for SAR in the CAG library, the link to which is at the top of every CAG page. There is a £10 statutory fee which should be paid by postal order.

 

The charges and ppi can be claimed back with interest.

 

The SAR should be sent recorded delivery and they will have 40 calendar days to reply.

 

In the meantime I would ignore Lowell. As this debt is more likely all charges, Lowlife won't go near a court with it.

If there was a period of 6 years where there was NO payment or acknowledgement before you set up the DD, then it will be SB.

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

That is very interesting ... mmmmm .. i will see what the SAR produces as i have had nothing to do with any of my debts for at least 8 yrs !! and i have 8 accounts totaling 15k !! ill health was the main factor behind my debts and i moved house 3 times so they was unable to contact me until i applied for credit jan last year.

 

Thankyou for your help this is going to be an interesting journey ...lol

i only set up DD with 5 DCA's since feb 2010 but i've cancelled all payments and sent CCA requests , the first to reply was Lowell with the document i posted above, is that an enforsable CCA?? there was no other paperwork just that which looks like an application form??
