just means some nasty DCA is phishing around your CRA file.

sadly they can do that

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Outstanding Debt/ debt collection searches are allowed,

and can be seen by potential lenders, the only restriction

is that there are reasonable causes for search and they

are not in an unreasonable number.

Can it be removed? Aktiv Capital did a search on my file in 2009, Mucky Hall (for the same debt) did one in Jan'11 and April'11.If the debt is more than 6 years old and I haven't acknowledged it can I get this removed from table 1 on my credit report? Thanks in advance

If the debt is SB it is reasonable to request the

removal of the searches, you will need to state

your case in writing to the COMPLIANCE MANAGER

of each of the DCA's, The CRA' cannot act without

their consent.

it appears to only be Equifax that allow these, and they must be contrary to law in some way.

 

How can they possibly allow these specific table 1 searches to remain for 2 years, and be refreshed almost indefinitely

All the CRA's allow it some times the way they are shown differs.

The posting of these searches is allowed by the FOS and the ICO

as they believe it's ''wise'' that potential lenders should see these

entries before making a decision to grant credit.

The searches have to meet the ICO's principles of use and accuracy

of the reasons to search, if the DCA is doing ID searches/residential

these should be unrecorded searches not seen by anyone other than the data

subject.

Yes as said write to The Compliance Mangers.

Can you check when the last payment was made,or acknowledgment

in writing sent?

I haven't made any payments in 7 years or acknowledged the debt. lol sorry you did answer my question thank you. So write to Mucky Hall and request that put in writing that the matter is over? Should I write to Akitv Capital even if they have past on the debt to Mucky Hall? Another thing is that I haven't received a letter from Mucky Hall but I know they have made a search on my credit file and I suspect that they have sent one to a former address. Should i put my current address on the letter?Is there a template letter I could use?

I just wondered if you had any ''default markers'' on your

credit file it will usually show up against accounts that

you have stopped paying or have missed payment on'

it will also give an indication as to the date of the last

payment.

Last ditch attempts me thinks those 2 DCA's are

well known for buying or trying to collect debts

that are SB or nearly SB
