Please help

- I purchased a car a few months ago using Duncton to finance it.

 

I have seen many posts here giving bad experiences, but mine isn't at that point .. yet!

 

I have a dilemma,

I dealt with Duncton via another company creditplus.

 

They dealt with all the paperwork.

 

Everything went through fine and after a couple of months of taking delivery of my car,

I received a letter from creditplus, saying they never received original documents (they never asked until now).

 

They sent a copy of the credit agreement I had scanned and emailed back to them.

 

They placed white stickers by my signatures asking for me to resign and send back urgently.

 

The white stickers read:

' This is a true and accurate copy of the original documents signed and dated by me/us X

 

Does this mean they need the originals to be able to enforce the agreement?

 

If I dont sign are they entitled to take the car away?

 

I have made all payments to date.

 

Any advice is greatly appreciated.

Hi

- so it sounds like Creditplus are relying on you to supply documents that clearly should have gone to them from Duncton (is that the car dealership?)

- if so and you signed up at their premises then they are wholly responsible as an agent for the finance company

- if it was me I wouldnt re-sign anything after the fact and Im not sure thats even allowed.

 

I also dont think they can penalise you the customer and take the car away due to someone elses errors in filing or whatever it is.

 

I am no expert but having the original credit agreement is paramount.

It probably is enforceable, but all the same I would not sign the second document. Sounds like the broker has messed up and Duncton are refusing to pay them out. Either way, it is not your problem and there is no reason why you should re-sign. They can't repossess as a result of their own error.
