    • Hi Dave, Yep .... Will have to do AOS tomorrow .... Are you referring to CPR 31.14 Request?
    • I don't think I've ever seen someone appeal a mags court decision on fare evasion, JK, but as you say in this case TiredDodo has pleaded guilty. It is possible to challenge, as below. HB Appeal a magistrates’ court decision: Overview - GOV.UK WWW.GOV.UK How to challenge a decision by a magistrates' court. Including how to get a fine reviewed, if you did not know about your case, how to appeal to the...
    • Update! I have now opened the mail from Barclaycard. I am assuming that their letters were prompted by my confirmation to them of my change of address, which I had advised them of twice. They are treating my change of address notification as a "General Data Protection Regulation Right of Access Request"  and state that I have made a "Right of Access Request. They are asking me to provide valid indentity documents! I have made no such request and am minded to ignore their request for extra information? I should add that their letters were sent to my correct current address!
    • Are you allowed to appeal if you plead guilty?   I know you appeal the sentence, but the criminal record formed from your guilt would surely remain?   I'm not sure if your able to appeal a crimianl record if you plead guilty are you?
    • DX: I did not pursue Link after I got the CCJ amended to monthly payments. Pretty sure the CCJ does not mention reviews, I do have the CCJ somewhere, I will have to look it up in storage. It is as mentioned on the thread you referenced  in your post #28. The Barclays loan was taken out in September 2004 for 60 months! Current Balance remaining approx £2K. On checking back my past correspondence with Barclaycard about this loan, there was a history of them ignoring my letters and offers to pay, and I even had problems in obtaining their bank account details for them to accept my payments! I have received strange correspondence from them too, one referring to insurance which I did not have. They seem very disorganised! Barclaycard told me to pay "Masterloan" a while back and I now receive regular statements and arrears notices from "Personal Loans from Barclaycard" clearly marked Masterloan, they changed the account reference number! I have never requested a CCA on this account. I advised them of my change of address last September, but they are still sending, until today, statements etc. to my old address! I have received 2 letters from Barclaycard Loan today though, not opened them yet!!

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

:D How long have I waited to see my thread title change? Too bloody long lol :p

First of all I received a letter first thing this morning from our lovely friend Kirstie Ross with a full and final offer for the amount that I was claming plus interest up to date. Also included was a cheque which I swiftly placed into my bank account.

So I won't be going to court tomorrow even though I would have loved this to go all the way to the point that YB were made to answer how they worked out their charges. Hopefully the day will come soon where 1 bank will be made to do this. Until that time we can all stay strong and supoort each other.

Yes I know this may seem like an Oscar speech but I want to take this opportunity to thank all my fellow forum users who have given me great support during the past 9 months especially those that sent private messages and kept me sane. Without you I probably would have given up all hope.

Finally I really can't thank caro, Robertxc and BankFodder enough for everything they do on this site. Caro you've been there throughout my claim not only on this site but you've had me sending you rambling emails when I've panicked and you've always taken time to calm me down etc

Lastly a message to anyone that is currently claiming or about to start this process...

Don't ever give up!!!!

Oh and Richard... Bigger Kisses Back ;)

Survey completed...

Donation when cheque is cleared...

Litigation details on way when I figure out what I need to tell you haha

For the benefit of those of us with court dates shortly, could I ask what you did to make them pay up. I am going to ring the court this morning to see if they have received YB court bundle and, if not, am going to fax Ms Ross personally to ask where it is. Any tips on wording fax appreciated. I bet you feel on top of the world today.

I did fax Ms Ross on Tuesday just to see if that would make things move and obviously it did. I'm not that great with words so literally wrote that I hadn't received a bundle from them and stated that the judge had ordered them to be sent 14 days before court blah blah blah  I then just finished the fax with.... "Would you be kind enough to let me know why I've not yet recieved the court bundle as our court date is 2 days away" :D It worked for me so I guess it's worth giving her a swift kick up the proverbial backside if you're really near to your court date.

I really can't express how stressed I was feeling on Tues, but that stress dissapeared very sharply yesterday morning and yes I am now feeling like I'm on top of the world.

Just stay positive and you WILL WIN.

Sarah.
