      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Well time moves on and Compaq laptops are STILL overheating or get uncomfortably hot - too hot for anyone's lap. its now 2011 and my daughter and i each have a compaq laptop and hers closes off when it overheats whereas mine gets hot and hotter!!! It gets so hot i can't stand it on my lap anylonger so i tip it onto its side on the bed and lie down to watch programmes etc. Typing is do-able but difficult.

As for using it only on a hard surface - ITS SOLD AND BOUGHT (in good faith) AS A LAPTOP - if i wanted to use it on a hard top eg table or desk i would have bought a desktop PC. But when i want to use it on the train, in the cafe, park or backseat of the car a PC is heavy to carry!!!!

 

A Laptop should never head out to burn peoples legs!!

 

Compaq should seriously think a redesign of the fan, battery and charger system - cooling them down - (the charger gets hot too).

let me guess one of the compaq CQ series? or if its a hp one of the G series?

 

the ventelation on those is terrible and its common for the fan to clog to the point where it cant be cleaned without a partial strip down

Yes a CQ70 Pesario. I've sent an email to COMPAQ complaints. Lets see (1) if I get a reply therefore acknowledgement of all these complaints in the forum past and present (2) see if they (or HP now) are prepared for a redesign that will impact the users instead of the quick profit gurus.

One can but try! If they are not aware they wont do anything will they - so I've told them now.

 

Thanks for the heads up re: the clogging of the fan too. Not had to do that yet but system restore yes. everything fine now except for the heattttttttttttttttttttttttttttttttttttttttttttttttttttttttttttttttt.

Get yourself a can of compressed air and give the fan/vents a good blast while the laptop's off. I had a laptop in for reinstall the other day and it kept just shutting down, eventually stripped the back panel off and gave the fan a good blast clear and things improved immediatly!

but with the cq desgin the fluff tends to jam into solid balls that air cant shift

 

trust me im doing around 5 - 6 stripdowns a week to clear these

Despite the name, a 'Laptop' is not designed to be used on a persons lap, as the positioning of the legs will often block the fans and thus cause units to overheat, and raises issues for potentially burning if it's on bare skin.

 

If you do use the notebook (the new name for laptop) on a flat and hard surface, does it still overheat?

compaq CQ- and HP DV- have very poor heatsinks. If you are willing to open them up you can place a square copper sheet between the processor and heatsink with therming gel which can lower temps by 10deg. There are videos on youtube somewhere.

or just use artic silver paste.

or just clean the fan occasionally.

 

and the DV series is a Nvidea chipset which is a differnt issue and a known one admited by hp at that
