Greetings All,

 

Just received a 'Seizure & Distrain' letter through our door from Newlyn plc marked for my

father's attention, chasing some £300-worth in items from our home over some "Road Traffic

Contravention" charge held against his final car from way back in October 2010.

 

The joke of it?

 

My father died in April 2010.

His final car was sold to someone else a good 2 months before he died...

a good 8 months before the "contravention" charge was incurred.:roll:

 

Oh...

 

And the letter doesn't even have any signature or local authority/county court stamp.:roll:

 

Any thoughts on how to deal with this nonsense swiftly and effectively?

 

Along with how the hell a charge incurred by someone else could come back to our doorstep?

 

Please let me know, people.

This is appalling, it could be a mix up with the DVLA, or a new keeper not notifying of the change, I would contact Newlyn and tell them that the vehicle had been sold in January 2010, and that your father who had disposed of the vehicle actually died in April 2010. they will likely want sight of a death certificate. I would contact your MP as a matter of course and complain.

You don't have the same 1st name as you dad do you?

 

What difference would that make? Car was sold 8 months before the contravention, but for whatever reason it seems on the strength of first post, father was still down as OP.

 

The Op must be given the best advice to enable them to send Newlyn on their way, and to cease and desist any wrongful enforcement.

An email/registered letter MUST be sent to Newlyn immediately.

 

As for the local authority, this may well be on the letter. Many times, the letter from a bailiff company for an unpaid PCN will provide the PCN number . This will start with 2 digits followed by 8 numbers. For instance, Transport for London PCN's start with TL, Lambeth is LB and Medway is MW.

 

If you do have this then please post back and I can advise you which local authority this relates to.

 

In most cases, Newlyn represent: Harrow, Barking and Dagenham, and Newham

Greetings All.

 

Thank you so much for your feedback on this issue.

 

Newlyn had since sent another Notice.

 

So a relative of mine phoned them and clarified the situation; and is sending

a copy of my Dad's Death Certificate to make the point.

 

As a result Newlyn are apparently putting their Notices 'on hold'.

 

If anyone there is sensible, this nonsense should be over and dunked soon enough.

 

Will await outcome and get back to you.
