    • Hello, Following the submission of my defense, last night I received an email from DCBL indicating that the claimant intends to proceed with the claim (I've attached a screenshot of the email for reference) along with the N180 directions questionnaire. I'm unsure how they obtained my email, but I suspect it was through the courts' form when I completed the Acknowledgment of Service. This email almost slipped my attention. I have also today received a letter from court to state they have received my defense.  It appears they are requesting an online telephone hearing with the court.     • Default Amount £9237.88, all this started in 2006 Admitted debt £9075.65 Weightmans added £1515.01 immediately they became involved, no explanation The Statement shows when Marlin bought debt in May 2011 £10439.25 Their statements, not received until the SAR, are based on this. Cabot deducted £1515.01on their statements in January 2019, again did not find this out until SAR. Weightmans added in  2007 after the CH1 etc was confirmed by the court £741.50, made up of Process server fees, Court Fee (they tried for bankruptcy), Solicitors fee and Land Registry fee. Unspecfied Legal costs were added by Marlin in March 2015, again I did not know this until statements received with SAR I had been paying monthly, without exception until December 2018. I am minded to take the property charge, CH1 amount ,deduct all my payments and the subsequent fees, and request/demand a refund on the final payment made? I consistently disputed Weightmans balances, but they never responded. I also told Mortimer Clarke/Cabot that I disputed their amounts.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

hi im trying to sort out a payment plan with mini credit but i get no where .You have to email through their site and then you get same reply .Then you get an email saying they are trying to email you .Idont really want to ring them i dont wanna get upset

hi i have received an answer phone message saying to pay the loan etc , so i have emailed them saying i want a payment plan and im not making part payment while they keep putting on charges .the balance is 308 pounds now in 2 weeks on a 100 pound loan .

here is the email At the moment You are refusing to make partly payments although You were told that we accept any partly payments towards the balance until we start Legal action.

 

The due date was on the 20th of June 2011 and the loan has been overdue for 16 days already. 

 

All the charges will be added until full repayment and the account should be cleared within 90 days from the due date to avoid legal action.

 

We accept partly payments You make on Your MiniCredit.co.uk account, but we do not offer payment plans and freeze the balance.

 

 

The Court will also see that You have not made any payments towards the balance voluntarily and it will also be taken into consideration and provides us the possibility to claim the Attachment of Earnings for the County Court Judgement.

MiniCredit are the worst of the worst for customer service and charges no one has ever got into a payment paln with them they just dont play ball at all , i have several outstanding payday loans all but these and cfo and payday express have put me into a plan , i didnt want to risk defulating with minicredit due to the horror stories so i rolled over for a few months tried to roll over today but was refused {£5.50 for the pleasure of refusal !!} bit the bullet and decided to pay in full {£5.50 for the pleasure of paying in full two days early !!} . I will never use these or any payday loan again

i just cant win with these guys if you make a payment they add on 5.50 for processing fee.so i wanna pay 10 but gotta pay 15.50 so all they are getting is 5.00 now ,what a nightmare

can someone help me here .i am trying to pay part payments up to loan plus 1 months interest but whatever i pay i have to add on 5.50 each time .the others dont do it .i dont know what to do .

hiya molly, if you go on your account on minicredit, and you will see FAQ, click on that and click on not found right subject or something similar. you can email there and they will get back to you. they dont freeze balances and dont reduce balances hardly.i had a £100 loan with them its been 3 months and it was over £500, so i made a payment of £150 and im not making any more payment they can take me to court all they like!!!!!!! dont panic or worry molly your not alone in this mess.just pay the original loan and one months interest x

yes they answer with the same thing ...dont accept payment plans ,do accept part payments but dont freeze interest or charges and must be paid within 90 days or they start legal action .im sure youve heard all that .i will keep emailing them

please can anyone advise received another email the amount is now 330 pounds.i have to pay within 10 days or it says they may contact my employer and start legal action ,i dont want them contactiing work ive only been there 2 weeks

Hi there

 

Im in the same situation as everyone else re mini credit except for that I have never recived an email just a letter stating someone will be round and I owe them £500.00 for a £100.00 loan, £80.00 which I only received as in the small print it say they charge £20.00 to deposit the money?

 

I have emailed and email, tried to call and no joy. I have saved the loan plus one months interest and have set it aside in order to pay a full and final settlement.

 

I have no idea how this company is allowed to trade under these circumstances. Its scarey and extreamly intimidating behaviour.

Hi guys, you might want to read this you may find it very interesting and helpful.

 

Mini credit are C**** - I will explain in a moment.

I have had every type of credit going! I am 21 and in £8,000 worth of debt. I have acquired this debt in 12 months. I am not proud of this and recently have been very upset and worried, however I turned to the CCCS who are a charity which help people who are in debt who want to help themselves. I am now on a DMP paying back £162 a month to ALL of my creditors. I shall be debt free in just over 4 years. The creditors have frozen interest and stoped calling as they are now getting regular monthly payments from a trusted source.

My creditors include

Shop direct (very, additions, little woods etc)

JD Williams

Studio 24

Santander

Lloyds TSB

Natwest

 

And the dreaded payday loans (used pretty much all of them)

Cash genie

247 Money box

Mini credit

1 month loan

Capital finance one

Payday express

Tooth fairy finance

Txt loan

Mini credit are the WORST creditor (if you can even call them that) EVER!

 

I had a £100 loan in April. I only received £80.00

It is now the 11th July and the balance stands at £627.00

I have emailed them hundreds of times to get no response, I have spoke to them on the phone and offered them full & final settlement of the original loan plus 1 months interest and the least they would accept was £350 – I told them to whistle!!!

They threaten you with debt collector and to contact your employer.

However I would like to inform you that they don’t send these debt collectors and they don’t contact your employer – these are scare tactics to get you to pay up.

 

It is actually ILLEGAL for a bailiff to enter your property unless a CCJ has been filed against you and you have missed a payment through the court. It is also illegal for them to discuss your dealings with them as they would of not passed data protection.

A CCJ is where the judge looks at your income/outcome and 9/10 will award with the payments you offered in the first place anyway as you cannot give the money you don’t have!

So keep to your guns keep emailing mini credit (so you have proof you tried to make offers)

 

The CCCS made them a monthly offer and I haven’t heard anything back from Mini credit yet so I am unsure if they have agreed to my plan but they are still accepting the money.

Also DO NOT PAY on their website £5.50 processing fee? JOG ON SUNSHINE… that should be £5.50 off your loan total but its just another crafty way of getting money.

 

Also report to the finical ombudsman I have and am awaiting a response.

 

Finally MINI CREDIT IF YOU ARE READING THIS-

How F****** actually are you?

No wonder you are finding it so difficult to get money out of people who have got themselves into a position where they are unable to pay it back… you don’t accept payment plans!!

Would it not make more sense to accept a plan with someone over 6 months and get the money back then have the hassle of going through the courts to get it back then having to wait about 2 years???? Mmmmmmmmmmmmmmmmmmmmmm

hi im sick of these morans.i have received a letter today saying i now owe 491 pounds.On the website i owe 506 pounds.It states if i havent paid in full by 30th july it will be referred to their doorstep agent . ive told them im willing to pay but im not paying 5.50 each time i make a payment .I have again requested their bank details ( which i know i wont get ),My question is do i just save up the payments each month then pay it in full ?

Hiya, I wouldnt worry too much about these, they are horrid to deal with, and will bombard you with allsorts of mail / email but it is all just scare mongering to try and force you to pay over the odds. Personally I would carry on doing what you are doing (writing/emailing), then if you get no response wait for it to go to DCA. If you can save a F&F settlement then happy days, but i would not be paying them anymore than the original £100 (hard cheese I think for the £20 fee - although you could contect this seperately) + 1 months interest minus what you have already paid (including the daylight robbery £5.50 charge). Work out what you owe then when it is transferred to the DCA pay them the amount via bank transfer (you could consider charging them £20 for same day payment lol). Job done - they should go whistle for the rest!!!!!

All you owe Minicredit is the original loan and one months interest - nothing more. They are trying to fleece you.

 

Get complaining to the OFT and Trading Standards now otherwise you are wasting time posting on here.

I have offered thema repayment plan countless times on the phone, offered to send them bankstatements to prove I can not afford to pay the lump sum but I just keep being told that at minicredit they don't offer payment plans and my interest will keep building up. What would I say if I did complain to OFT/Trading Standards? Would it not be dismissed because I am in the wrong because I haven't paid?

They would be in the wrong not you, you have tried to pay and the are refusing. They have no leg to stand on.

hi im so angry have received a letter today saying despite our efforts to sort this ,what a laugh i have been trying for two months to get a payment plan with them .

they say they are sending a doorstep collector to my address between the 12th and 18th of august.,and have added another 100 to the balance.
