    • I have had a secondary thought.  I borrowed £s from a completely separate entity 6y ago. It was personal and unsecured. I was going to repay upon sale of the property. But then repo and I couldn't.  Eventually they applied and got a charging order on the property.  Their lawyers wrote that if I didn't repay they may apply for an order for sale.  I'm not in control of the sale.  The lender won't agree to an order for sale.  The judge won't expedite it/ extract from trial.  Someone here on cag may or may not suggest I can apply for an order v the receiver?  But could I alternatively ask this separate entity with a c.o to carry out their threat and actually make an application to court for an order for sale v the receiver instead?
    • You left the PCN number showing, but no worries, I've redacted it. Euro Car parks are very well known to us.  I've just skimmed through the titles of the latest 100 cases we have with them (I gave up after 100) and, despite all their bluster and threats, in not one have they taken the Cagger to court. You stayed there for 2 hours &:45 minutes.  I'm guessing the limit is 2 hours and 30 minutes, right?  
    • If the claimant fails to draft directions the court can order a Case Management Hearing to set them but normally in Fast Track claims the claimant sets the directions...Unlike small claims track which are always set the court.
    • Not Evris offer, the court offers mediation service.   All claims proceed to hearing if mediation fails /not happen.   Why do you not wish to attend in person to stand your claim ?     Absolutely you must comply with the courts directions or your claim risks being struck out.     • LPA.  (I'm fighting insolvency due to all the stuff that he and lender have done).  He appointed estate agents - (changed several times). Disclosure shows he was originally appointed for a specific reason (3m after repo) : using his powers as acting for leaseholder to serve notice on freeholders (to grab fh).  There was interest from 3 potential buyers. He chose one whose offer depended on a positive result of the notice.  Disc also shows he'd taken counsel advice - which was 'he'd fail'.  He'd simultaneously asked to resign as his job (of serving notice) was done and he'd found a buyer.  Lender asked him to stay on to assign notice to the buyer.  Notice failed, buyer didn't buy.  So receiver stayed.  There was 1 buyer who wanted to proceed w/o fh but receiver/ lender wasted 1y trying to get rid of them!  Disc shows why. But I didn't know why at the time. In later months Lender voiced getting rid of receiver. Various reasons - including cost.  But there's a contradiction/ irony: as I've seen an email (of 4y ago) which shows the receiver telling lender not to incur significant costs and to minimize receiver costs.    Yet lender then asked him to serve another notice - again counsel advice indicated 'he'd fail'.  And he did fail.  But wasted 3y trying and incurred huge legal costs - lender trying to pass on to me. Lender interfered - said wanted to do works.  Receiver should have said no.  But disc. shows he agreed to step aside to let them do the works - on proviso lender would discuss potential costs first (they didn't), works wouldn't take long (took 15m), and lender would hold interest (they didn't) (this last point is crucial for me now - as I need to know if I can argue that all interest beyond this point shouldnt be allowed?)   I need to check receiver witness statement in litigation with freeholders to see exactly what he said about 'his position'. But I remember it being along the lines of - 'if the works increased the value of the property he didn't have a problem'.  Lender/ receiver real problems started at this point. The cost of works and 4y passage of time has meant there is no real increase in value. Lender (or receiver) didn't get any permissions (statutory or fh) (and didn't tell me) and just bulldozed the property to an empty shell.  The freeholders served notice on me as leaseholder for breach of covenants (strict no alterations).  The Lender stepped in (acting for me) to issue notice for relief of forfeiture - not the receiver.  That wasted 2y of litigation (3y if inc the works) and incurred huge costs (both sides).  Lender's aim was to do the works that every potential buyer balked at due to the lease restrictions.  Lender and receiver knew couldn't do works w/o fh permission. Lender did them anyway; receiver allowed.  Receiver remained appointed.  I'm arguing lender interfered in receiver duties.  Receiver should have just sold property 4-5y ago w/o allowing any works.  Almost 3y since works finished the property remains unsold (>5y from repo). The property looks brand new - but it was great before.  The lender spent a ton of money - hoping that would facilitate a quick sale.  But the money they spent and the years they have wasted has meant they had to increase sale price.  It's now completely overpriced.  And - of course - the same issues that put buyers off (before works) still exist.   The receiver has tried for 2y to assert the works increased value. But he is relying on agents estimates - which have proved highly speculative. (Usual trick of an agent to give a high value to get the business - and then tell seller to reduce when no-one buys.). And of course lender continues to accrue interest (despite 4y ago receiver saying pause interest). Lender tried to persuade receiver to use specific agent. Disc shows this agent was best friends with the lender's main investor in the property.  Before works this agent had valued it low.  After works this agent suggested a value 70% higher!  The lender persuaded receiver to sack one agent and instead use this agent.  No offers. (Price way too high).   Research has uncovered that this main investor has since died.  I guess his investment is part of probate? And his family want it back?    Disc shows the sacked agent had actually received a high offer 1y ago.  Receiver rejected it.  (thus I don't know if the buyer would have ever proceeded). He was relying on the high speculative valuation the agents had given him to pitch for the business. The agents were in a catch-22.  The receiver sacked them. Disc shows there has been 0 interest ever since (inc via new agent requested by lender). I don't think lender or receiver want all this to come out in public domain via a trial.  It will ruin their reputations. If I can't get an order for sale with lender - can I apply separately against receiver?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I am after some advice please.

 

Having paid in full some time ago for my Wedding Album, I am now looking at going to the Small Claims Court. I have been trying to resolve the issue amicably for a long time now. Paul Fisher Photography will not answer his phone when I contact him and very rarely answers my e-mails. When he does answer my e-mails, he never actually answers the points I have raised. He just simply makes a promise that he never keeps to. I have sent him various letters (Supply of goods 1982) to which he claims have been sent to the wrong address as he no longer lives their (I receive abrupt e-mails from him). He does receive them as he eventually answers them. I have been sending them to both of his last know addresses of which his family members still live.

 

As he refuses to inform me of his correct address, am I able to send the court summons to his last known address? and will this be valid for me to do so? I know his parents still live there. Just not sure if they have a legal responsibility to inform him of a court summons letter.

 

Other advice I am after. When I fill in the paperwork, do I have to also include all proof in the initial paperwork? or is this only sent to Paul Fisher Photography if he chooses to defend himself against my claim? I do not wish to provide all details as this may make his defence easier on the day.

What addresses are on this company's paperwork/invoices ?

 

As a rule a claim is issued to a Registered office/Head office. But it looks as though this person works from home, yes ?

Thanks for information so far.

 

Basically, when I booked and paid for my wedding album he had his own shop and website. Since then, he no longer runs from the shop and I was informed by his website provider that he failed to pay for the website services; hence his website no longer running. He claims to still be running an active business but will not provide any contact information other than his mobile number and e-mail address. He will not answer his mobile and rarely answers his e-mails. I have challenged him with regards to vetting his calls (all calls go to answer phone) and he has neither confirmed or denied this.

 

Long and short of my problem. I initially sent my first letter to his last known address which was signed for and he eventially replied to it (2 weeks late). He informed me that he no longer lives there now. I then contacted his parents who informed me he does not live with them.

 

So what address to I provide for the Small Claims Court?

 

If I was to send the court letter via e-mail and received a read receipt, would this stand as being delivered when I arrive at court?

I assume the problem is he never did the album (you haven't stated the problem) you therefore require the payment refunded ?

Ok onto your summons you will serve it at the last known address (his parents) dont worry when they open it they will make sure he gets it.

If they dont it goes in your favor as he will not respond or defend the claim.

Is there any vat reg numbers or company numbers on the paperwork? have you searched companies house? Or is he a one man band?

The problem I have is that I paid in full for our Wedding Album and he has not produced it. He keeps making promises but constantly fails to deliver. I have reported him to various authorities such as Trading Standards, Action Fraud and the Police. All have done very little to resolve the issue. Action Fraud have now noted the issue as fraud but to date have done nothing. Trading Standards sent him a letter to which he ignored.

 

He is a one man business. However, his partner at the time helped build the business. She now claims they have split up and as such stated she has nothing to do with the business. That said, various people have informed me they are living with each other (neighbours and a friend of his).

 

I even have e-mails that he has been auto forwarding to his so called ex-partners account. That is how I made contact with her. She also set up an e-mail account in his name and signed various e-mails using his name. It is for this reason, I believe they are together and she is still running the business with him.

My reason for going on about her is due to the house being in her name only (land search). Not sure if I can but the debt against the house if he fails to pay up; which I believe he will do.

One other question I have.

 

Does anyone know if the Court Summons envelope has any official marking on it indicating it has been sent from the courts.

Just wondering as this may cause some concern to his parents when it arrives and may kick start the reality check of his failings.

Hopefully he may pay up prior to going to court.

Yes Dea it has Northamptons stamp on the summons but the envelope may have their Logo on. HMCS

 

Service of the claim form where the defendant does not give an address at which the defendant may be served

 

6.9

 

(1) This rule applies where –

(a) rule 6.5(1) (personal service);

 

(b) rule 6.7 (service of claim form on solicitor or European Lawyer); and

 

© rule 6.8 (defendant gives address at which the defendant may be served),

(2) Subject to paragraphs (3) to (6), the claim form must be served on the defendant at the place shown in the following table.

In the real world, what would this mean to me? Getting Judgment is one thing getting your money is another if he fails to pay

you have further options as above, Bailiffs or ATE ( Attachment to earnings)if employed.But we can cross that bridge if and when.

Think hard before going to all the expense of suing him, as to whether there is any realistic prospect of enforcing any judgement you might obtain.

 

You have no idea where he really lives, nor of where his business premises are. How, then, do you hope to send in the bailiffs?

 

Have you properly considered whether to sue - as a co-defendant - his female business partner, who might have been a partner in the business at the time you agreed the contract terms? She appears to have a known address, to which you could send the bailiffs.

 

You also appear to be unclear as to what you are seeking. Are you actually trying just to get your money back? Or are you seeking damages for breach of contract on top? Or are you seeking possession of the photographs he took?

 

Would you be better off employing a Solicitor to bring a private prosecution for fraud? If there is no realistic prospect of enforcing any county court judgement, he could still be prosecuted for obtaining money by deception, fraud, or conspiracy [with his business partner] to defraud.

I have given thought to suing his ex partner but to be honest, I am not sure if I can. She informed me via e-mail that she helped start the business with Paul Fisher but she now claims that they have split up since. However, they where together at the time of my wedding.

 

When she helped set up the business with Paul Fisher, they used her home address as the business address. This house is in her name only. When I paid Paul Fisher he hadhis own studio at the time. His ex partner informed me verbally that she also helped set up this studio with him. She has never informed me that she was a business partner; only helped set the business up.

 

So based on your experience, should/can I sue her.

DeaBea, not quite sure what help you are requiring from me.

 

I see that andyorch has given you a good deal of information regarding CPRs and Ed has advised you to think carefully before proceeding.

 

IMHO, I too would be a little wary about issuing a claim upon someone at an address that may or not be the correct address and where, if you were to obtain judgment by default you would obtain no redress due to the bailiffs not having an address to act at ?

 

In answer to your question.. yes, there is usually a frank on the envelope which indicates that there is a court document contained within .

Hi,

 

I am still in the process of finding his current address. I believe I have the correct one; just require confirmation prior to submitting papers.

 

However, if I was to go ahead with the small and obtain a judgment by default, would this put a CCJ against his credit record. If so this would make life difficult for him.

 

Another point I have as raised by Ed999. His ex-partner helped build the business with him. They were together when payment was taken ( I have proof of this). Prior to Paul Fisher gaining his first studio, he used his ex's home address as his business address. Again, she informed me that she helped build the business. Surely he could not use an address as a business address without the permission his his partner.

 

In short, am I able to sue her as she is the sole owner of the address?

I still am not clear, and - more importantly - nor will the Court be.

 

Are you trying just to get your money back? Or are you seeking damages for breach of contract on top? Or are you seeking possession of the photographs he took?

 

Let's start, please, by you clarifying whether he took any photographs.

 

Secondly, I think you need to consult a Solicitor. This is a specialist claim - holiday damages and wedding damages are always specialist claims. You won't get the best possible results without a specialist lawyer acting for you, because this type of claim is - or may include - a claim for damages for disappointment.

When she helped set up the business with Paul Fisher, they used her home address as the business address. This house is in her name only. When I paid Paul Fisher he hadhis own studio at the time. His ex partner informed me verbally that she also helped set up this studio with him. She has never informed me that she was a business partner; only helped set the business up.

 

So based on your experience, should/can I sue her.

 

 

In my opinion, if you can sue her - i.e. if you had a contract with her - then you should sue her, given that the other person, Fisher, may be difficult to enforce a court judgement against.

 

Only a Court can decide what the legal effect of your contract is. The burden of proof falls on YOU to prove in court who you had the contract with. You must prove that the woman was in partnership with Fisher in the business and that your contract was with the partnership, or your claim against the woman will be likely to fail.

 

You obviously have some evidence that she was a partner in the business, from what you say about her admission that she helped start the business.

 

I recommend that you obtain legal advice as to whether you have a valid claim against her in law, and that you take into account the additional legal costs which you may have to pay to her if you lose. Your Solicitor will advise you about your liability for costs, depending upon what type of claim you make.

 

Consult a Solicitor, or take the risks of a DIY court action.

Can I Win?

 

Unfortunately, the type of questions you are asking boil down to 'Can I win my claim?' This is a question that only the Court which hears the case can decide.

 

The Court will take into account the evidence which is given at a hearing by you and by, or on behalf of, the opponent. This evidence will only emerge by cross-questioning of the witnesses.

 

The outcome of a Court case is never certain.

this is all very odd - what is with all the private PMs? that sort of thing always seems ropey to me.

 

As to the claim - can't add anything to the above advice. Depending on the amounts involved, and what actually happened with the photos, then I'd consult a professional.

There is nothing ropey about the PM's. The person who I have been sending PM's to had some very useful information for me. The information was nothing to do with Advice and was intended for my eyes only. I resepect his wishes and reasons and as such I will not divulge it to the forum.

 

However, I do thank everyone for there valuable time and advice as it has been of great help. The situation is now being resolved (slowly) as Paul Fisher Photography does not wish to go to court.
