      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi Guys,I am going to enter in to negotiations with these guys about my outstanding PDL. I have left it late as the repayment is due tomorrow.I informed my bank to change my card as a precaution earlier this week but i called in to check my DD's and there seems to be one set up by WDA. I had it cancelled but the operator said that they can sometimes re activate the DD for this? Can this be done and if so how can i prevent all my ££ being taken from my account before i manage to get a repaymkent plan in place? Thanks

Hi ronzo, I would suggest moving any monies you have in that account out of it immediately, if your salary gets paid in tomorrow, yoou will need to call your bank today to find out what times they update, and get the monies moves to another account at the time of day, may find it can be at midnight, or any time in the early hours. WDA I think normally try for money around 5-6am though I could be wrong. I would wait until tomorrow to contact them, when you know for certain the money has not gone to them. Make sure the funds are moved, and they can not touch them. Keep all contact via email/post. so you have a paper/elctronic trail of everything. Advise them you can no longer afford the repayments and wish to clear the loan and one months interest on a repayment plan, make them an offer that you can reasonably afford, and take it from there.

Thanks BonMMy salary is paid in tomorrow and i don't really have any other account i could shift the funds to. I was just going to pop in and take all the money out and sort another account out after then?It would mean i'd need to be at the bank for 9am to get it as early as possible. Since i cancelled the DD from them will this not buy me some time?

I hear what you are saying, and you SHOULD be ok, but if you want to guarantee it, I would suggest you try to maybe transfer the funds to a family members account? Is that a possibility for you? In the meantime, also set up a new bank account, try halifax or co-op. I would certainly do this as soon as your funds are live in your account. Call your bank, find out what time your salary is usually cleared for you to draw on and do it then! Don't wait, and don't give them a chance or opportunity to take more from you than you can afford.

Well this morning i got up and checked my account and all was fine.BUT from the 6am till 9:30 there are £800 worth of debits pending on my account leaving me in a really bad way. I previously cancelled my card and cancelled my DD but they have still managed to take the money??Is there anything i can do?

Hi Ronzo!Was this money due? And did they debit the correct amount as agreed in your credit agreement when they said they would?If so, I do not believe there is anything you can do. Which is why I did say to make sure you move the funds at around 5am or so into a friend or family members account. You could try contacting your bank and informing them that you had cancelled the DD and card, and this is a non authorised payment, and take it from there. Fingers crossed for you!

I wondered why i had recieved a text thanking me for my payment and offering me up to £150 more :-( Previously when i have got that text and called for a reloan on the day, they said that it takes till the next day for the system to show that the payment went through or not so i thought it was just an automated text :-( The amount / date is correct i'm afraid this leaves me in a very un manageable situation.
