Dear All


We are new to the forum and sorry if this has been posted before.


We have been in Australia for 8 years and are returning next year. we left the UK will a small amount of debts, CC etc.


What is likely to happen on our return, will these debts be gone will our credit history show nothing and what if the creditor has obtained a CCJ on those debts in the time we were away.


Nobody has contacted us here in 8 years in relation to these debts.

After six years (five in Scotland) a debt becomes Statute Barred and cannot be enforced.


Even if they managed to obtain a CCJ in your absence besides the facts it would have dropped off the records they would need to apply to a court for permission to enforce (very rarely if ever given) you would be able to have it set-aside in any case as a CCJ cannot be obtained against a non-UK resident.


All in all it is highly unlikely any creditor would be aware of your return, even if you applied for a bank a/c, mobile contract, credit etc they would only require your previous addresses over the past 5 years.
