    • Yep, I agree with what you are saying, I only mentioned the governing body code of practice as a nod to the fact that I wasn't dismissing the BPA or whoever out of hand, thought that would go in my favour before a judge. I wrote a long post about the BPA CoP earlier but then deleted it because I realised I wasn't talking about points of law but a set of guidelines drawn up by one bunch of charlatans for another bunch of charlatans. It is ludicrous that the 5 minute consideration period doesn't apply if the motorist parks, such nonsense. As for legislation, I was referring to the government legislation (if it is legislation?) document which has been withdrawn. Does that stand until it has been reintroduced? In the explanatory document it is quite clear. Otherwise, how does one hold them to the consideration and grace periods? Or is that at the discretion of the judge?
    • Thank you all   JK, I agree; if they were to accept my full claim today, then the interest would be around 8-9 pounds. If I were them, I would have offered to pay the interest and said no to the 12 pounds for the letters. These have not been mentioned, which is my mistake.   As you pointed out, if the judge were to award at 4% and I did not get the letters, I would get less.   Bank, thank you. I do hear what you are saying. If I am to continue with this, then I will need to pay an additional trial fee of £59. If I win everything, then great, but if I win less the claim and court fee, then I lose out. I am not sure what the judge will think about the interest. I think we have to remember that I won the item and, therefore, did not pay a penny for it. Yes, I have had to purchase an additional one, but maybe the judge will hold this against me. I am content that this is a win. I have not signed any non-disclosure clauses, and they do not ask for this either in their offer. 
    • Are you saying that both businesses were closed? Yet you stayed there for over two hours. . If both were closed than to charge £100 is a penalty since Horizon had no legitimate interest in keeping spaces clear for the company. sake as there were no customers..

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Please someone help, I dont know what to do. I went to court last June regarding arrears I had to Amber Home Loans, I am a single mother with 2 children and one on the way, my husband left me and is know where to be found! I lost my job and couldnt afford to get my children into a creche whilst I worked so the judge suspended the re-possession order on the terms that the DSS would pay some money off my arrears and that I was to pay £75pound a month towards my mortgage and £25pound a month off my arrears which then were around £9000. So on the 30th of each month from June 2010 I paid £101.32 to my mortgage company.

 

However due to the change in the benefit system the payments made by the DSS were lowered and aparently I was to pay the shortfall, but I couldnt afford to jump from £101 a month to nearly £400 a month, so I continued to pay the £101 anyway, I was then hospitalised for a month with bad kidneys and so I fell behind on the £101 and I recently paid that back it was £300 pound in total, but now i have recieved another court letter for September this year, I really dont know what to do, I tried to ring the solicitor and discuss how we can deal with this without it going to court. They completely dismissed me saying I didnt make the shortfall payments from the DSS payments (Which I didnt think I had to pay in the event this happened as it was never mentioned in court) and they were taking me to court and that was that.

 

The arrears are now £11.000 Im really at a loss here as to what to do, I have recently been awarded DLA as I am mentally ill and this isnt helping me at all, I have 2 children and one on the way and I am beside myself with worry, is there anything I can do?

Hi there, this must be a very stressful time for you - however please try to stay positive and let's see what we can do to help.

 

First thing is to complete a budget sheet - include all your income and outgoings - this will give you a picture of what is realistically affordable. I have affixed the budget sheet we normally use to this post - it calculates automatically as you enter the figures. Once you have done that we will look at what the next step is.

 

Can you confirm

how much is the normal monthly payment?

how much are the DWP paying?

 

Have the CSA been involved to find your husband re maintenance for the children ?

What is the Other Benefits Income ?

Are you in arrears with your gas & electricity - I notice you have put the same amounts in priority debts section?

What is the hobbies amount for?

 

Have the CSA been involved in trying to get maintenance from your husband?

Hi

 

The other benefits is DLA, I shouldnt have written anything in for gas and electric as I pay both as I need it, and I put the entertainment down as sky tv and broadband. I wasnt too sure of the form.

 

Without sounding crazy my husband and I had a bad relationship where he was physically violent towards me, I really dont ever want any contact with him again and I think the last I heard was that he was out of the country living! I dont want him to have any part in mine or my childrens lives.

 

Thanks for your help, I am at my whits end, I am expecting again too and I havent stopped crying for a week.

I do understand how distressing this must be for you, and how you must be feeling about your husband. However, there is no need for you to be in contact with your husband - the CSA would do all that and you need a contribution towards the childrens upkeep or you will struggle to keep your home.

Have you considered applying for the mortgage rescue scheme?

 

There is a way forward with this but it means you will have to cancel your Sky subscription to save some money and write to your credit card company offering a smaller payment of £10 per month (we can help you with the letter).

 

I have affixed a revised budget. This shows you have enough disposable income to make up the difference between the DWP contribution and the normal mortgage payment and also leaves you £100 to pay towards the arrears. If you can offer this to the judge I think you will have a very good chance of success, especially given your circumstances with expecting another baby.

 

If you agree with the above I can help you with your defence for court. As we have quite some time before September - it might be a good idea to write to Amber explaining your situation and enclosing the budget sheet (I can help you with a letter). They may accept your proposal and cancel the court proceedings - it's worth a try and if they don't cancel, it will show the judge that you have tried to come to an arrangement with them.

 

Are there any arrears charges added into the total arrears they say you owe?
