    • Why would you pay for  service you know to be rubbish? Block their email address and report it as spam. Ignore them.
    • Start off by clicking this link https://www.consumeractiongroup.co.uk/forum/183-postal-and-delivery-services/ that will take you to the beginning of the sub- forum where you will have all the topics which have been posted – listed. The first 10 or dozen or so titles referred to threads which are "pinned" and that means that they are fixed and they tend to be information threads and are not threads which have been posted by people asking for help. If you cast your eye down the various titles you will start to understand what the subject content of each thread is. Eventually you will get to a shaded bar which is labelled "other topics". That shows you the beginning of the various request for help that have been made by people including yourself. You will probably find your own thread at the top of those or near the top. The order changes according to the most recent which has been posted. Start using the forum more and you will get to understand the pattern. If you don't visit very much then it will always be a stranger to you

    • The NTK is not compliant because it states you overstayed but does not state what their permitted parking period is. Anyway the permitted parking period cannot vary from the original period when planning permission for that car park was granted, I suspect it was an all day job or certainly longer than 2 hours 45 minutes. It's always worth getting on to the shops you visited socials and declaring how you will never shop there again and drop an email to the CEO of the store you spent most money it. Other than that it's waiting time for a Letter Before Claim, then snotty letter time. Be prepared for a flood of every increasing threatening letters from the PPC and their tame DCA.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

waiting and waitign and waitign for my statements, they have acknowledged my letter and returned my cheque but as yet nothign to work on but the one year of statements i can access online ( oh and they have added £105 in charges this month alone :eek: ) in the last year ( given that we spent half of it in credit for goodness sake!) they owe us about £700 already, cant wait for the rest of the statements.... 20 days and counting

closey, see in your sig you had to file a warrent? what does that mean, do i understand correctly that they lost the court case and even then still didnt cough up :o no! am prepared to take them to court but didnt think id have to worry about sending in the bailiffs

It means they didn't acknowledge or defend my claim, therefore I filed judgement and issued a bailif court warrant against them. The money isn't in my pocket yet, but I'm nearly there!

i thought we were supposed to keep it all in writing then you have copies of everything. if i call them they may try and legalease me :confused: rather stick to the tried and tested, might send ther SAR non compliance letter tho that might wake them up...

list of charges received ( not a wedge of statements :) ) will calculate the damage in a mo but they assert in a letter accompanying the list of charges that our accoutn was opened i oct 2004 so all details relate to that period forward... thing is we got a 2 year fixed rate on june 2004 with them so i know we banked there before oct 04 as i have a statement ( a single lonely little statement) dated 3rd july 04. do i write back with the "you still have a few days with which to comply to my SAR and by the way here is a copy of statement number 2 dated july 04 contrary to your assertions that i opened the account in october of that year"... or do i call them? it may have been an oversight? it may also be that thay are tryignt o play silly peoples with me. they did list the charges out all niceley tho with the balance at the tiem so i can work out how much of the interest applied too :D very kind of them i thought.

thanks closey thats the letter i meant, have alreayd sent that one to abbey so got it already saved to the pc with the relevant details. adds up tho in the three banks im claiming for so far its over £2k!

standard "we're sorry you are not satisfied" letter arrived today. no mention of my complaint that they had ignored 6 months of my banking history with them( they claim in their letter that i have been with them since oct 04, i have in fact been with them since june 04 as i have a statemnent number 2 from july a copy of which i sent to them with my letter)

they will fully investegate my claim and aim to reply to me by 26th october.... hmmmm. well thats sad cos i am sending the LBA on the 11th and will be filing MCOL on 26th october so it will be nice if they can get backto me by then :p

hello i had my 2 letters from the woolwich they owe me pretty much the same. bit confused myself as the last letter was a list of my charges since account opened. nothing else so dont know what to do next any ideas?

alan i think you need to open your own thread mate.

anyhow just follow normal procedure send your prelim letter for your charges back and then your letter before action ! all relevent letters are in the templates library section but first you need to read the FAQs so you understand the procedures you need to follow if you know what your doing before hand it means your not going to make mistakes hope this is of help to you ?

hi tilly, thought i recgnised the name matey :)

alan, the standard protocol is to start a thread for each bank you are going after. that said you are more than welcome to post here too :) woolwich sent em a list of charges, i filled out the spreadsheet ( in the library on this site) and then sent then the Prelim letter ( asking for it back) they have sent me a few guff letters offering a timetable for my complant of 26th october, i will ignore that and 14 days after the prelim send the LBA ( letter before action, the give it back please, or ill sue letter) they get 14 more days then i file MCOL ( moneyclaim on line, the online versions of court papers, yes actually suing them) they will defend ( another 14 days ) then they will wait till 27th day of the following 28 days they get to come up with credible eveidence as to why these charges are viable ( they cant cos they aint) and then they will settle the full ammount out of court. basically about xmas time i should get my wedge back :) toot toot if you need any help there is normally someone about :)
