Not sure if this has been covered elsewhere or previously, so here goes.

 

The likes of DWP: Housing Benefit: Council Tax Benefit and similar are to trawl through CRA files with no other reason than to find those co-habiting. Their statement ran along the lines of:

 

If you apply for a benefit as a single person, then someone else either already lives at that address, or moves in and then seeks credit a new 'link' is being marked up so that these people can be caught out when making fraudulent claims!

 

It is also to be used against pensioners claiming they have less in savings than in reality.

 

I personally am going to complain to the ICO because surely this was never the reasoning when setting up CRAs.

Its nothing new and merely a tool to prevent or investigate crime.

 

I know of one particular CRA that offers its service to law enforcement agencies and you get access to a shedload of data.

 

I doubt you will get very far with the ICO.

Yes I announced this last August I think Experian were awarded the contract.

They will also be using it to track gone aways who have outstanding warrants.I seem to remember that there will be commission paid too.

FFS, the CRAs are allegedly partly owned by the same people who own DCAs. This country is becoming more like Russia every day!

Here is an interim report published earlier this month.

It shows that all new Working tax credit applications are being checked against credit file data.

right so its just the i.d. side they're interested in. fair enough. but the thought of the tax payer lining the pockets of the same directors that own the DCAs makes me puke.

oops, sorry to re=post, it was in, I believe, the Daily Mail this week, and I didn't realise it was 'old news'. I must agree with others that this is getting more like the 'old' Russia, perhaps we should now stop claiming of buying anything, it is a definite return to the 'olden days', many of us odies, and, I suspect not so oldies, have already returned to keeping any spare cash under the mattress and dealing as little as possible with banks.

 

I do not condone any type of 'fraud', but my dealings with HMRC on behalf of my sister have left me in a state of dis belief at the system as a whole. After many, many hours of research I have found hidden away in the depth of the .gov.uk website the piece of information that I needed to 'prove' what I had said all along and after having been ignored by the Pension Service, had the 'phone put down on me by them also because I insisted I was right and they were wrong, I finally got them to admit that the piece of information I had found was completely unknown to anyone at the Pension Service!! but it has proved that we (my sister and I) were right all along and her pension and pension credit have been incorrect for nearly 5 years!!

 

So what hope is there for any information 'they think' they have uncovered to not automatically put those people in a potentially distressing position?

Yes many people wonder why there can be sudden collection activity against them just as they settle one debt.

 

Well Experian alerts them...

 

Customers who've gone into arrears usually become solvent again at some point in time. We'll monitor your debtor accounts and let you know when a customer's ability to pay has improved so you can immediately start working the account again and collect the unpaid balance

it has just happened to me. Have settled a barclaycard and within 3 weeks Egg have sold me loan to arrow who will be chasing soon enough

I am going to question the legality of Experians right to share

this data on a commercial basis, as when a CCA or other agreement is signed

I believe the data is only to be used within the definition of personal credit and should no be

sold on without the data subjects permission which is not given under the signature

on the said contracts.

Yes true.

There are always clauses in an agreement where they say they reserve the rights for sharing with third parties and credit reporting.But when an agreement is terminated,by default or assigning,then the original agreement ends,ansd so with it should any permissions.

Although I am not an expert on CRA I believe they were borne out of the need for creditors to have somesort of database where they could check out potential debtors.

 

Therefore it is no surprise that when they find people are not paying they will refer to the CRA.

 

Whether the Government and other public bodies should be accessing CRA files is another matter I spose.

Don't agree with looking into spending habits but I do agree with it being used to catch out those who claim to live alone but don't.

 

Perhaps they can reduce our tax with all the savings they make (as if)

I have no objection to this.the way i see it, this can only help save the taxpayer (me) money by stopping fraudulent claims for benefits that people are not entitled to.I am all for using the private sector to improve the efficiency of the public sector. Would anybody object to the Child Support Agency (or whatever it is now called) using a CRA to track down an absconding and neglectful father?

Well mate, it won't be long before our medical records are processed by Experian as well.

Hi bob, I am in principle in favour of stopping fraud etc. but the debt collection agencies using

a ''Robust'' approach to recovering over payments, have little regard for the probability

they the individuals they are dealing with may be some of the most vulnerable in society,a

least when the government departments dealt directly they had the full records of the client

to guide and moderate their handling of the individual case.

A DCA's handed minimum details of amount of debt and what it's for with no

background are going to be on dangerous as from experience they appear to have little or

no knowledge of the laws and regulations governing government debts.

Simple things like stating that debts owed to for instance cannot be statute barred, I have dealt with

quite a few cases of this nature, and of course these debts are cover by the Limitations Act.

 

Great care needs to be exercised, IMHO.
