      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I've now got my SAR back. It's a big wad of paper so I've only had time to flick through it. I did ask for PPI information but at the moment I cannot see anything apart from what's on my statements. I did specify I wanted this information. Even if there isn't any agreement in the notes can I still calculate the PPI (I'm asking for it back.) Or do I get in touch with them again to ask them for the signed contract. It is a long time ago and I think it was done over the phone so not sure. Thanks.

They should have supplied a full transaction history and you should be able to identify the ppi payments from those. You don't need a contract/agreement to do this.

Hi

 

As this is a credit card you can claimthe monthly payments plus compound interest right up to date at the rate they charged you on your card. I've attached a spreadsheet which will calculate the claim amount for you. As you go through your SAR papers, enter each of the ppi payments you find into the spreadsheet.

 

You only need to enter data in columns A, B and C and change the APR in the blue section to the rate they were charging you. The rest of the claculations are done for you.

 

Then simply change your personal details in the blue section of the sheet and the resultant completed sheet is your schedule of claim or SOC.

Thank you so much for this. I've never liked working with figures but somehow I think I'm going to enjoy this!!:-)

 

:thumb: and don't be put off by the size of the figures....compound interest mounts up quite quickly to a sizeable sum.

I need to ask another silly question! I'm just inputting all my PPI into the spreadsheet. As I've been going through them the PPI differs a lot eg Aug 05 it's only 94 p and then a year later it's gone to £15. Can you tell me the reason for this? Thank you.

No its not a silly question

 

On a credit card ppi is charged based on the O/S balance. The higher the debt on a month by month basis, the higher the risk. So PPI premium is based on the level of O/S debt. The higher the debt, the higher the PPI premium for the month.

 

Just another way of getting money from the debtor....simples!

When you get in touch with your credit card company to reclaim PPI - do you have to use their questionnaire as I don't know all the answers. Can I just send a letter?

Best thing is to download the consumer questionnaire from the fos website and use that one.

 

You can only answer what you can.

see post #10....change the APR to the rate they were charging you, i.e. the rate on the card. The daily rate will fill itself in.

I've just had a reply from my Credit Card Company. They are going to look into my complaint of mis-sold PPI. They have said they will try and be as quick as they can but in any event within 16 weeks. I'm surprised I got a rather quick acknowledgment and the letter was reasonably nice. I was expecting them to say 'no' in the very first letter.... calm before the storm I bet.

Thank you for that. This morning I received one of their PPI questionnaires. I've been in touch with them regarding it being mis-sold. I've already told them the details and I was going to fill this one in but the questions are too in depth for me to remember it was a long time ago. I do know they didn't tell me I had a choice to go elsewhere and my employer would still pay me if I was off sick etc etc. They did say even if I don't fill this questionnaire in they will still look into it for me. However, if they are advising me they have partly investigated my complaint but need more information and I haven't got anything else to give it might go against me. If I do fill it in there isn't much I can add to my previous letter.

 

Is it best to try and fill in what I can or perhaps send another letter.

Personally I'd download the consumer questionnaire from the fos website rather than use the one you have been sent.

 

You can, of course, only fill in the details you remember but as you go through it you will be surprised at what might come back to you. :wink:
