    • Back to octopus from the smart meter/tariff salesperson. Octopus have now said just ignore the letter - I dont have to have one despite there letter implying (at least) it was required, but that i will HAVE to have a smart meter if current meters stop working as 'their suppliers dont supply non smart meters any more'. They also say they do not/will not disable any smart functionality when they fit a smart meter I am of course going to challenge that. Thats their choice of meter fitter/supplier problem not mine
    • Point taken that we should inform new Caggers that the £20 option is there in wrong registration cases.  Well, supposedly there, who knows what the PPCs would do in practice.  Anyway, the option is allegedly there with both the BPA as you say, but also the IPC (I've just checked). However, there's a danger here of baby, bathwater. The two easiest types of cases to win are (a) residential - due to Supremacy of Contract and (b) wrong registration - due to "de minimis".  Indeed until recently we has been boasting that no Caggers, over two years, who had sent a PPC the wrong registration snotty letter, had even been taken to court, let alone lost a court hearing. We simply can do nothing about a terrible judge.  The judge seems - I say seems because we haven't had all the details - to have ignored "de minimis",. got fixated on a sign and awarded unreasonable behaviour costs.  A totally bizarre judgement.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I can say that I have had a response and am told that a reply will be forthcoming on Saturday.2nd.July.

Any news on the complaint to the police?

 

Just a quick note:

 

The OP did tell me the other day he will be without internet access until Monday or Tues of next week. He has said he will pop round to his parents home (possibly today or Sunday) and update this thread accordingly.

I am actually thinking of giving a helping hand to BAYV... It's quite clear (to me) they have got themselves into a bit of a pickle... So... I have a solution... I will offer to take all their existing threads, and roll them over into one BRAND NEW thread, and then give them 3 years to answer them all... Of course, they will have to agree to having a coin meter fitted to their computer, and their existing post count re-set to zero!

Hi. We are currently investigating this issue.

 

We have been in contact with the customer to take a statement. We have interviewed the member of staff involved.

We have also spoken to the police and are waiting for an official response.

 

As soon as we have completed the investigation, we will post a formal response.

Hi all

 

just looking for advice, ill tryin keep this short,

 

first of all ive been with buy as you view for around a year now, in feburay i got a new item from the, but was told the my payment would go back to 3 yeard and that meant i would pay no extra my payment would be the same,

 

i got a new table and chairs from them, great no hassle next time payment was due, i was told to pay £105 when my contract says £75 so i paid to get they guy out of my home, and then called to speak to a manager who never came, next payment date i refused them entry on the grounds that they had broken there agreement and again asked to speak to a manager,

 

then yesterday afternoon i had a nock at my door, it was the same bayv collectors this time with 3 police officiers,he showed me some paperwork with my girlfriends sig prooving that table was delivered to my address,i told him i want to see the contract he said ive come to remove your goods, i said you are not coming in, as i said that the police officer said " what you say" i repeated then he arrested me for "breach of the peace" on my own doorstep, handcuffed me and put me in the back of a police van and allowed the guy into my home to remove the goods,

 

then they tryed to get me to sign a consent form in handcuffs, wich i refused, the collecter left with my goods and then the poliuce de-arrested me and let me back in,

 

the bayv collecter left the consent form, but this one was not filled in all left blank,

since then ive been trying to speak to a duty inspecter to find out why the police acted in this way and why they let him enter my home without a court order,

 

ive also contacted bayv whol told me my area manager would contact me that same afternoon, i ve heard nothing,

 

i have never had a late or missed payment, and have been told they have to serve you with a default notice before they can take any sort of action.

 

what are my options here,

I think if the OP is so inclined BAYV could end up in court over this and quite a bit of compensation would be due.

I hope BAYV realise that and approach any resolution with that in mind, so it does not go that far.

As I understand it, Buy As You View are waiting on a statement from the police force involved.

 

Buy As You View have contacted me privately with an assurance that a full and thorough investigation is currently in progress - and CAG will be updated as soon as this has been completed.

Her reply... [excuse the "txt spk" she can spell really, but I wanted to relay it verbatim - minus the swear word]

Here is a little something ALL customer service managers/directors should keep in mind...

 

If you perform well, and make a customer really happy, chances are that customer will recommend you to a friend!

 

However...

 

If you perform badly, and REALLY **** a customer off, you can guarantee that customer will tell EVERYONE!

I don't live in Surbiton, but I am still disgusted, in the shoddy treatment, the lack of consideration, and if accurate bare faced lies from this company. Companies live and die on customer satisfaction, even more so in this tough financial climate. So I will go out of my way to tell everyone, even the old bidie at the bustop, what a shower of chancers you are. Are you that dense that carrying on like this leads to P45 land.Go on prove me wrong, I'll be happy that you can. We all like a happy ending !

Just a quick update to all those following this thread...

 

I have spoken with the OP (chrisyb1984) on the telephone today. He tells me that other than the one telephone call from Linda Davies (BAYV Customer Service Director) more than a week ago, he has had no other contact, and has not yet been asked to provide any kind of written statement. He does, however, have an appointment at the police station dealing with his complaint on Friday.

 

The OP currently has no access to the internet, so I have agreed to give him a call every other day for updates.

 

It is now almost one month since this thread was started, and I believe the time has come to see a full and proper conclusion to it.

So what offences may have been comiited by the Police/BAYV - if any?

 

Presumably the copper has done somehting that warrants a disciplinary and BAYV have probably breached the CCA - and probably both have tresspassed or something but are there any offences?

I thought my question was quite clear to be honest - what criminal offences have been commited. I wasn't making or implying any thoughts on the matter.

 

 

That said, if no offences have been commited then it is much more likely to be brushed under the carpet by the Police.

OK. See what you're saying...

 

To be honest, I don't ever recall anyone mentioning anything about either the police or BAYV committing any CRIMINAL offences... (The only reference to "criminal" I have made is how I felt the BAYV employee may have attempted to make a CIVIL matter appear as a CRIMINAL matter.)

Trespass and an unlawful reposession quite possibly, and for the police, as there was no breach of the peace, and no warrant or authority for the Bayv people to take goods, wrongful arrest and unlawful detention perchance theghost?.

We could do with some help from you.
