      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

We are to assume it was the BAYV employee who called the police, and requested their assistance. For the police to then attend meant they had, in effect, been hoodwinked, and tricked into appearing as if they were ENFORCING the repossession - which of course, they were not, or at least they weren't SUPPOSED to be!!!!

 

this is exactly what i think has happend, like the officer dealing with my complaint said " the police were not there to aid bayv or myself, but to stop any breach of the peace happening" so the bayv rep as hoped when i open the door and see the police i automatically allow them both to enter!!!!! wich infront of the police i still refused him entry, wich ended up in me being arrested,

This is very important, as it would appear that this particular employee of Buy As You View is using the police service (ie - requesting their attendance) to make a civil law repossession APPEAR to be a criminal offence. And, in the heat of the moment, it could be easy not to question this. After all, anyone would take a step back at the appearance of three police officers at their door.

 

And that, in itself, is a breach of the peace in its literal sense. YOUR peace was breached, you felt THREATENED, and you were caused DISTRESS. And this could certainly explain your agitated state when the police DID arrive.

 

I'm pretty sure where you need to go with this, OP, but I think we should still give Buy As You View the courtesy of an opportunity to respond, and to complete their "thorough investigation."... Although, I have to say, my patience is wearing pretty thin...

well at first i never mentioned it because i thought the card read" phone i will come" ? it wasent until i photo copied it and blow it up i relised it said " police will come" so when i was back at the police station i give him a copy with the rest of the stuff.

scan the required letters/agreements/sheets

as a picture file

remove all pers info inc barcodes etc using paint

but leave all figures and dates.

goto one of the many free online pdf converter websites

convert the image to pdf format.

or ir you have PDF as an installed printer drive use that

open a new msg box here

hit go advanced below the msg box

hit manage attachments below that box

hit the add files button on the top right

hit select files, navigate to your file on your pc

hit upload files

at one point i even refused to pay and i was told if i did then they would send the police as i had stolen the goods
so iam in abit of a mess over it all i dont want to break the law
i've spoke to them about trying to mve it down they are refusing but as i sed in the first post i need 2 go higher up the chain with them the area manger is giving nothing and the way he puts it i either pay or they remove the telly if i refuse both the police will come and have me arrested 4 theft now i would have thought with no credit agreement i wouldnt have 2 pay a penny more than i have as they cant prove i've asked for it but they say cos i havent paided over half they dont need a court order they can just walk in and take it or they will phone the police if i dont allow them to take the telly as it then becomes theft

I saw that too and immediately thought of this thread. Now that it has been moved from general issues to the right forum, help may come from bayv (deliberate small letters).

I wonder if BAYV are hanging around with Lord Lucan and Shergar

I am hoping the OP has had some contact from Buy As You View today, and will have an update later this evening.

 

I was expecting a response on here from Buy As You View today (seeing as they were logged in at around 2pm for an hour or so reading threads) but, alas, it would seem the company still wishes to remain silent. Quite as to WHY Buy As You View requested official company representative status here is starting to become a bit of a mystery...

 

There are SEVERAL threads currently on this forum requiring input from Buy As You View, and this is just one of them.

 

No doubt CAG members will draw their own conclusions to this, but I think this silence is doing serious harm to the company's image.

Thank you so so much for this thread. I was days away from getting items from BAYV, I have now told their rep that I am no longer interested. Phew.

 

I think it's about time the police were trained to deal with these thugs though. A while back, I had a contract with Perfect Homes. I missed one payment due to being in hospital with my son, and they decided to come knocking my door, shouting through the letterbox as to who they were, etc. I made an official complaint to the company and witheld my payments until this was investigated.

They kept coming to my home, knocking on my door shouting "You owe us money, open up" even when we weren't in.

It got so much that on the final occasion, I phoned the police as the guy wouldn't leave.

The police turned up, "phew" I thought, until the cow on shift took great delight in telling me this uncertified debt collector was well within his rights, and she tried to get me to let him in or hand back the goods. I refused, and she then told me that he could legally come back when I was out, break in, and if he didn't want to take the items on my contract, he may legally take other items, like my TV, my son's cot and my son's toys. I told her she was mistaken, and she then threatened to allow this guy to force entry. I said if she did I'd have her arrested.

Eventually they all left, and their was a very swift email fired off to her Super. He then apologised profusely for her behaviour and disciplined her.

How can we expect these people to uphold the law when they don't understand it. It's ridiculous!

This beggars belief and bayv have shown themselves for what they are by their actions to customers and their treatment of CAG.

 

About time they were put out of business once and for all in my opinion.

I am really, really disappointed with Buy As You View. Not only that, but I now have to go and eat humble pie before all the other site team members, because I stuck my neck out and recommended giving the company "approved customer service rep" status at CAG! I genuinely believed that the company would make other rent-to-own retailers sit up and take notice, and follow their lead.

 

It is clear to me that, as a company, BUY AS YOU VIEW are desperately trying to clean-up their image, and become a respected household name. After all, if BRIGHTHOUSE were able to pull this trick off, why can't BUY AS YOU VIEW?

 

But the problem BUY AS YOU VIEW have is that their business model depends too much on individual account managers (with their own little empire, so to speak) and cannot easily be contained into one generic brand - like BRIGHTHOUSE. This is where ALL of BUY AS YOU VIEW's problems come from.

 

Directors at head office can sit there all day long, issue carefully worded statements on consumer advice forums such as this, spout off well written PR, and publish lovely glossy internet magazines - but all of that gets trampled on by a team of stressed out field account managers, desperate to meet their targets, and driven by commission and bonus payments...

You have put this quite well,and it hits the nail on the head.

 

Yes,I can confirm here,that in view of what we have seen in the past,many of the site team were reluctant to agree that BAYV would be capable,or willing to respond completely to the challenge of dealing positively and openly on the CAG.

 

However,equally we are all aware that you have personally tried to move mountains to that end,and its not for want of trying.

 

Like you say,a good business model has to be created and implemented from the top down to the shop floor,and like a chain,it only needs one weak link to see the rest fall apart.

 

These days,more and more businesses are learning from what their customers have to say online,and in many cases,new business practices and regime change occurs after there is a realization of how that needs to be done after reading customers reports suggestions and complaints.

We can only but hope that your input to these forums will eventually get the attention it deserves,by those in the position to admit the errors of their current ways.

The nature of the allegations and questionable practices outlined in this thread are very serious.

It may well be the case,that BAYV are conducting an internal investigation at this time,I can understand that.

However,if that is the case,there is no reason as to why BAYV cannot come here and just confirm that this is the case.

 

This does not prevent the many other threads here getting a response.

 

I will be sending an email today and asking for this,as part of our expectations when we agreed to offer them Official status on the CAG.

Hi all

 

just phoned linda davies as today id still had no contact from bayv, anyway shes asked me to give them time as my complaint is still being investigated, she also said that she just been in a meeting with paul bell the reginoal manager, so hes in wales at the minute if its to do with the complaint she never said. she is also waiting for a statement from the police.

This has been going on far too long IMHO. Did Linda give you any time frame? It's 14 days since you started this thread, and probably months since you 1st asked for a manager to look into your complaint, I feel this has been going on far too long, you must have the patience of a saint.

 

How can BAYV expect to repair their business relationship with you after such a breach of trust?

If in doubt, contact a qualified insured legal professional (or my wife... she knows EVERYTHING)
