Perhaps you have discovered a long lost relative has left me a fortune in a will and I could give up work to pursue my love of goat farming using the money to set up a small holding in the outer Hebrides producing fine cheese and goat hair sweaters. Alas no! In bold letters it stated Letter before action almost if one had to get ready for battle and my power ranger pyjamas will have to be on a boil wash first before I can even think about action. Anyway I digress after further research I discovered this is in relation to some parking shenanigans of which I have no knowledge and for a place I've never been to, so as the Private Parking world's best solicitors you should be aware, I know that you know a case isn't going anywhere on the facts as presented.     • Good news.  They haven't bothered to send the authorisations you asked for, so in your WS later you can say you believe they don't have them.   EDIT  Indeed in your defence now you can state that you believe the claimant doesn't possess important authorisations.

      Sorry for only updating you now, but after your guidance with submitting the claim it was pretty straight forward and I didn't want to unnecessarily waste your time. Especially with this guide you wrote here, so many thanks for that
      So I issued the claim on day 15 and they requested more time to respond.
      They took until the last day to respond and denied the claim, unsurprisingly saying my contract was with Packlink and not with them.
      I opted for mediation, and it played out very similarly to other people's experiences.
      In the first call I outlined my case, and I referred to the Contracts (Rights of Third Parties) Act 1999 as the reason to why I do in fact have a contract with them. 
      In the second call the mediator came back with an offer of the full amount of the phone and postage £146.93, but not the court costs. I said I was not willing to accept this and the mediator came across as a bit irritated that I would not accept this and said I should be flexible. I insisted that the law was on my side and I was willing to take them to court. The mediator went back to Hermes with what I said.
      In the third call the mediator said that they would offer the full amount. However, he said that Hermes still thought that I should have taken the case against Packlink instead, and that they would try to recover the court costs themselves from Packlink.
      To be fair to them, if Packlink wasn't based in Spain I would've made the claim against them instead. But since they are overseas and the law lets me take action against Hermes directly, it's the best way of trying to recover the money.
      So this is a great win. Thank you so much for your help and all of the resources available on this site. It has helped me so much especially as someone who does not know anything about making money claims.

Can an employee be sued by a customer booking a holiday? HELP

Ignore the clerk they can be very helpful or they can suffer from DRS (Doctors receptionist syndrome).


You'll be okay with this one the claim was a huge abuse of the court system and the claimant is likely to end up paying a lot more than the £700 for it if you have solicitors fees involved now.


I still advise you just inform the police that this person has taken a vexatious action against you from a previous employment and has now tracked you down to your home address and current employers. They might just drive by and knock his door for a little word.

As of 03/03/12 please do not under any circumstances wait for my further input or guidance on any current thread or defence of a court claim I might have been involved in on or through Cag.

I won!!! The very stern Judge had me worried for awhile, especially having said he never books holidays through a travel agent..

My previous employers solicitor was not allowed to speak so it was all done on me..

Eventually the Judge set the Judgement aside then advised me that the matter in his opnion was finished and that my employer would not need to take the case over..

He awareded me costs plus and extra £100 but something tells me I wont see a penny unless I enforce it but not sure I really want to carry on..
