Hi, i am relatively new to all this, but have grasped the early ideas. However i have a barclaycard debt(overdraft of just over £500), which Lowells have taken over and are sending out the usual letters. I sent off A CPUTR2008 request, and i have received details of the debt from November 2007. The debt is in my previously married name and only reappeared when i registered for credit expert. The details they have sent me are details of the account i used to have with them. The final line states branch recovery UN and then a/c closed. Is there anything else i can do or do i offer a monthly payment, or abigger amount to settle the debt?

Don't do anything yet, do not phone them or write to them!

 

Lowell's should be treated with suspicion and contempt.

 

An overdraft expert should be along soon to advise!

i would suspect this was written off against tax by the OC years ago, and this has been brought by lowlife on a phishing list

 

they have no legal powers to do anything.

 

pers i'd wait till they play their trump card, which is in effect nothing i bet.

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Welcome to the site.

If you are minded to accept that they have what they need to enforce legal recovery,then you can do one of two things.

Either offer a repayment at a figure which you can afford to maintain,or else offer a one off full and final settlement.

Either way,keep everything in writing-do not deal by phone.

Keep a record of anything you send,together with anything they send you.

When was the original agreement taken out ?

Its possible that they will not be holding all documentation they would need to take any action,what date was the account defaulted-and can you confirm if you have made any admission of liability either in the past or recently ?

Hi, the credit agreement was created on 22/03/1997. Also on the fiche documentation copy they have sent me, it states that the customer address has 'gone away' 10/04/06. Today i have also received a similar response from them regarding t-mobile, with some vague statements including early repayment charges and overdue mobile bills. This was dated for the last bill as 9th September 2005! I have not admitted to either debt and have not contacted them by phone, only to write the CPUTR2008 letter. There are early termination payments of £145 and £40 pounds for two mobile numbers i used to have. On a summary its has at the top an overdue amount of £289. Where do i go from here?
