      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Has anybody had any further communications today? I have had all the e mails mentioned in this thread and in addition I received the below today:

Carter Forbes are dodgy all the way around...But at the end of the day everyone must remember that if it came to going to court they will settle for 1 Month interest and the initial loan. The fact that they settle for that suggests they know in their pea brains that this amount is all they can get.So anyone in the same boat - do not pay any more than this and do not offer more than you can afford. This should be £5-10 MAX

I have just gone through the same experience as others posted here. I just can't believe that Carter Forbes are getting away with all of this. I had a payday debt with Uncle Bucks in 2008, which I honestly thought I'd cleared. I heard nothing from them until receiving a text last month (mid June) from Carter Forbes saying the debt had been passed to them and if I didn't get in touch they'd be arriving on my doorstep to collect it. I called them and was told that the debt now stood at over £1000 - how??! As far as I was concerned the account was cleared, and I'd had absolutely no contact from Uncle Buck during the intervening period. They obviously still had my phone number, which had not changed (and neither had my address - but nothing in the post), which was used by Carter Forbes to text me.

 

How can a debt be left unchased for 3 years while such a huge amount of interest accrues, and then they decide to try and collect the inflated amount??

 

Anyway, I agreed with Carter Forbes to pay £100 per month - the maximum I could afford, which I made perfectly clear to them. I made the first payment on my debit card and they told me that they would take £100 a month from the card on an agreed date. The next month I get a call from my bank telling me that they've taken the full £1000 - clearing my account out and leaving me not even 1p to live on during August - food, mortgage, travel to work etc. I called them and was told that they tried to take the £100 but card was rejected. My bank has confirmed that nobody tried to take £100 on the date stated by Carter Forbes, which I already knew because my pay was in before that date so money was definitely there. Have asked for evidence form them - no response.

 

I've made a complaint to Financial Ombudsman and CSA (Carter Forbes website says they subscribe to CSA code of conduct etc. etc.), and following good advice in this thread I'm also going to complain to the OFT and Trading Standards. These cowboys have to be regulated more strictly.

did you get the £1000 back if not do it now and dont stop still they [the bank] give it back under either the dd guarantee or chargeback

 

you do not owe that much, the max is the loan + 1 month interest

Well, well, well... following my last post of July 11 in which I received an email saying I had 14 days before my account was to be vetted for legal action, I received another email from them this week exactly the same... saying that I had 14 days etc. Looks like this could be some merry-go-round if this continues every couple of weeks!

If I remember correctly the sum £96.70 was what was owing to UB after all but one of my cheques bounced + UB's £10 charge. It still amazes me how they can make interest on £96.70 total nearly 3 grand in just 2 years. Thing is, I have not contacted them, and it's only now, 2 months after their initial email (and the shock of what they were claiming) that they're saying don't worry about it because we can get it reduced to £96! Yeah, like they're doing me some great favour!

Oh dear, have I ridden roughshod through forum etiquette? Apologies for hijacking, but I just thought that if all who are having identical experiences with CF came together to voice those experiences we could take some comfort in solidarity. All too often when you receive this sh1t you feel on your own. Also, if there is one thread dealing with a topic then it is better (imho) surely for our concerns to be dealt with on one thread rather than the people with the answers dealing with each thread separately. I don't know, maybe I'm wrong... just my thoughts. I'll stop rambling now.

Has anybody else received a further e mail from these clowns? They have sent me another 1 today giving me 24 hours to pay:

It is imperative that you contact us by 7pm today 31/08/2011 to make payment before your account is vetted for legal proceedings from tomorrow.

Call 0845 026 8042 to make payment via debit card or alternatively, reply to this email with the following details to make payment and we will reply with your receipt of payment:

· Long Debit Card Number

· Expiry Date

· Payment amount

· Date of next payment

Please contact by 7pm, if paid today, discounts of up to 50% may be offered.

Toshyboy, I've had the same email as you from a couple of days ago, and 3 texts since 'asking' me to settle by 5pm on the 31st before it goes for legal vetting - funny that, as they've said for the past couple of months each time I haven't responded that my file is going for legal vetting, whatever that means, and it never has. I've also been told in the texts that discounts were only available up to 5pm yesterday. Ho hum... let's see what happens now we haven't responded.

i have just had £720 taken out of my account without my consent! i had the fraud team ringing me up form my bank investigating this, i dont know how they have taken payment as i have only just got a new bank card in the pass 2 weeks and have't provided them with it, but they have had my card number and have now swiped all my account out! surely they cant do that!

They are NOT allowed to do that, complain to

Now go to the police and ask for a crime number (if they want to know why say you can claim back from the bank with one) then go to the nearest branch of your bank and put in a written formal complaint - give them the crime number at the same time and they will have to reverse the transaction.

 

Simply changing your card and account with the same bank is not enough. You need another account with another bank.

 

If you do not complain you are wasting your time coming onto this forum, yours may be the complaint that does make a difference come their CCL licence renewal time.

Do not give these clowns any of your card or bank details at all please. Sorry to hear of what happened to you katiemc85.I have written offering them the original loan plus one month's interest, and disputed all the additional charges. They then replied to say that the minimum they could accept was just over twice this amount - a fifth of the alleged balance but still completely unenforceable, and without any logic either. I presume this is a reflection of the amount they bought the debt for or their charging structure to Uncle Buck rather than anything else.I now keep asking them for sort code/account number and reference to quote so that I can pay them via bill payments, and referred to OFT guidance on accepting smaller payments. No response. Instead, texts now threatening doorstep collection instead of "legal vetting". Nonsense, will now be ignored completely.

Oft have just stripped a DCA of their licence and warned 119 about there actions so complain complain complain your complaint could be the one that gets them put out of business

We have given you ample opportunity to contact us regarding this over due account.
