Hi LK

They are not supposed to contact family or your work, it is against OFT Guidelines:-http://www.consumeractiongroup.co.uk/forum/content.php?416-The-OFT-Debt-collection-guidance

If they do report them to the OFT and Trading standards.

Have a read of 6 and 7 in my signature.

Pounds Till Payday cannot reveal any information to third parties which includes your family, friends and employer. If you are having trouble paying your loan I would suggest to contact PTP directly on 08000 327 655 and explain your financial situation to them so that an agreement can be reached.

Hey All,

I've email the companies ebfore i default and got this reply from Swift.

Any suggestions? I dont want to just pay the interest for the next 3 months and still have it all to pay!

"Dear

Your loan is due for full payment of £240.50 on the 27th June. When applying for this loan on the 2nd June you declared affordability and the loan was approved in relation to your income only, this was not a joint application therefore we are unable to accept a low payment of £30 towards this account, in addition to freezing interest.

We are a small family business and relay on full repayments for our business to continue.

Although we do appreciate that your current circumstances will cause you difficulties we would be willing to offer you an extension for the next few months, this would equate to a monthly repayment of £80.50.

We await your urgent response.

Kind regards,

Swift

Tried this response. Any idea folks?

"Dear Sirs,

I appreciate your comments, however this is not a priority debt, therefore if you are unwilling to try to come to an agreement with me, I feel I have no choice but to contact citizen advice.

As responsible lenders, I do not believe offering to let me extend the loan and pay only the interest, is responsible.

Do you have bank details which I can make token payments into, so to try and reduce my balance until the matter is resolved?"

Some progress has been made.

Swift accepted a repayment plan before i defaulted by standing order, however the remainders have tried my debt card this morning and tried to take their direct debts (even though both are canncelled) and are currently not responding to my emails.

Any suggestions?

Contact the Money Shops head office, they are usually more pro-active than the local branch. Keep emailing everyone else.

Try and set up another bank account as these companies will continue trying your bank account even though your card is cancelled. Halifax Easycash is a good option, as is the Co-op and the Post Office.

Thankfully, I've got a Halifax easycash and moved my money between the savings account i have linked to my main bank account and the Halifax easycash.

Thanks for the help. Its appreciated.

HELP! Uncle buck has cashed the cheques. The bank says there guaranteed so can’tstop them, and uncle buck won’t return my calls or discuss a repayment plan.

I didn’t guarantee the cheques (uncle buck wrote the details on without myknowledge) and apparently although the cheque cannot longer be guaranteed fromtomorrow, the bank wants to honour them today!

Any advice?

REPORT REPORT REPORT

http://www.consumerdirect.gov.uk For the OFT who have already told off PDL companies for taking payments when not authorised - remind them of this

http://www.tradingstandards.gov.uk

http://www.ripofftipoff.net - Trading Standards site which is gathering info on dodgy loan lenders - even though they have a licence they are still behaving very badly

The local police - ask for a crime no to get your bank to refund via insurance (even if you haven't got any)

I've informed the bank they gave altered the cheques, but the fraud team can't promise anything.

Consumer direct told me to ring debt line, but no body seems to want to help me get my money back (except you folks).

Emailed uncle buck saying I now can't afford my priority debts so reporting them.

Any more suggestions?

That is NOT for the bank to decide. Which is why we are telling you to go to the polce to report it and get a CRN, then go to CAB and get their advice, THEN go back to the bank and provide them with the evidence.

  • 2 weeks later...

Well What a mess!

The bank wont help, uncle buck wont return my messages so going to give the finical ombustman a try. Any other suggestions?

Dear Sirs,

I wish to make a formal complaint about the service I have received recently with regards to my current account.I contacted your call centre on 29th and 30th June to request for a cheque to be stopped.I was instructed on both occasions that the cheque could and would be stopped only later to find that they could not as they had been both guaranteed without my knowledge and the date amended by another person. I was charged £10.00 for the privilege of stopping a cheque which you later paid. You have been unwilling to assist me in trying to get a refund, and your fraud department are not willing to look into the changes added to my card by other persons.I have now also received £72.00 in fees as a result of the incident making me unable to pay my direct debit.I cancelled the direct debits via your internet banking before they were due; however you choose to ignore my instruction and tried to pay the amount.I am unhappy with the level and accuracy of information provided to me by your call centre staff, and your charges applied to my account.I would be grateful of a response within the next 5 working days, or I feel I will have no option but to look to advance my complaint to external bodies such as the finical ombudsman and the police with reference to the fraud on my account.

The Ombudsman will take far too long. Get onto the OFT (via Consumer Direct) NOW as Payday loan companies are high on their Agenda... and onto Trading Standards

http://www.consumerdirect.gov.uk

http://www.tradingstandards.gov.uk

You are wasting your time with the Ombudsman, they can't stop this company doing what they want, the OFT can stop their credit licence and Trading Standards can close them down.

Go to your local police station and ask for a crime number for this incident, then the bank will HAVE to stop your charges and give them back to you.

The Ombudsman is a waste of time, I will not reply on this thread again unless you follow the way we have learnt WORKS.

Call the police back and ask to speak to the senior officer - it IS a criminal offence to change the date on a cheque. Do not accept the CIVIL bit, it is NOT CIVIL BUT CRIMINAL. Stick to your guns and state that the bank have asked for this number to give to their fraud department to check. Tell them you need it to claim against the company in court (which will help your case should you take this route).
