    • Back to octopus from the smart meter/tariff salesperson. Octopus have now said just ignore the letter - I dont have to have one despite there letter implying (at least) it was required, but that i will HAVE to have a smart meter if current meters stop working as 'their suppliers dont supply non smart meters any more'. They also say they do not/will not disable any smart functionality when they fit a smart meter I am of course going to challenge that. Thats their choice of meter fitter/supplier problem not mine
    • Point taken that we should inform new Caggers that the £20 option is there in wrong registration cases.  Well, supposedly there, who knows what the PPCs would do in practice.  Anyway, the option is allegedly there with both the BPA as you say, but also the IPC (I've just checked). However, there's a danger here of baby, bathwater. The two easiest types of cases to win are (a) residential - due to Supremacy of Contract and (b) wrong registration - due to "de minimis".  Indeed until recently we has been boasting that no Caggers, over two years, who had sent a PPC the wrong registration snotty letter, had even been taken to court, let alone lost a court hearing. We simply can do nothing about a terrible judge.  The judge seems - I say seems because we haven't had all the details - to have ignored "de minimis",. got fixated on a sign and awarded unreasonable behaviour costs.  A totally bizarre judgement.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Right been Reading threads here for a while now and thought I'd get my personal finance mess sorted seen people with various amounts of loans but think I may be the 'winner' in terms of stupidity.

So here goes

I can just afford this but means cutting on my lifestyle.

the only thing I'm really worried about is that I live with my parents and was wondering if their credit rating will be affected by the defaults etc. I can't talk to them about money (previous credit card problems that I've now dealt with) so the option of taking a loan out with them is out of the question. I'd probably be thrown out the house. I can't sleep at night for worry and I've been to the doctors and I'm currently on meds for depression due to my inability to life within my means.

 

Any help,info or support would be much appreciated as these forums are the only thing keeping me sane

havent dealt with half of the companies, but you will need to persist.

i would ing each company once, then email til they accept..... lendingstream i know will agree to payment plan, but dont anwser emails.

pde express wont agree to anything..... is none of them accepts, put the money aside each month... vey unlikely any of them would go court route, but if 6mths down the line they did go to court, at least when u go you have 6mths of money... looks better and shows you were serious about your payment plan, when you go with 6mths money!!!

 

they all threaten court but vey few actually go that far..

Would it be possible to pay it back by snowballing, by pro-rataing some of these you are leaving yourself open to a long time paying them back... with snowballing you put them all into a 'pot' similar to a self administered dmp (but don't tell the companies that) and 'them what shouts loudest gets least'.

 

The first month you pay off a couple of the small loans, eg the ones below £250 and pay the others £35 each, then the next month pay off another loan, then the same the next month. Some of these lenders will pass the debt onto a DCA who will offer 'substantial discounts' which you then accept and pay off over 3 months. I got rid of 6 loans at one time in 7 months with this method.

 

I do hope you also remember the golden rules here,

 

1. Keep everything in writing, do not phone, emails are great as you have positive proof of what is said/agreed.

2. Work on the basis that the original (or last) loan amount plus one months interest is what the court would deem owed (this is due to their high interest rates, stupid unjustifiable fees and unreasonableness in not accepting part payments)

3. Get an alternative bank account as many of the companies will empty your account 'at will'. Halifax do an online account and you don't get a credit check with it, so does the Co-op and the Post Office.

4. If they threaten bailiffs will come and take 9 times the value of the loan from you that is a blatant lie, bailiffs cannot come unless a court order is obtained and even then what they can take is very very limited. You also would have had to default on the court order in order for a bailiff to be appointed. Many of these use 'in house' services such as Marshall Hoares and Daniels Silverman who aren't licenced for doorstep collection.

5. If anyone does threaten contact the following organisations

Ministry of Justice

 

Keep us informed if anyone plays around and we will give further advice.

 

If anyone does send court papers scan them on here and we can verify if they are genuine or not.

 

Keep up the good work, now you have taken control of the situation you should be able to see light at the end of a tunnel.

 

Another bit of advice is try to keep a spreadsheet of the debts and repayments made 'just in case' and give yourself a small 'reward' at the end of every other month after repaying a loan back, eg trip to cinema, night out, takeaway meal. That way you will feel that it is 'worth the hassle and anxiety' and not fall back into the trap again.

Hi guys, thanks for all your posts it's nice to hear from people who have been/are in the same boat. The snowballing plan sounds sillygirl but if I've already offered set amounts to the companies, will it help the situation if I then lower the amount I'm offering them?

 

I've set up an alternative account already and changed my bank details with work etc.

 

From Reading on here it's been said that capital finance one and toothfairyfinance are particularly hard to deal with. They've both already passed me on to a company called nothern debt recovery but on here it seems to be part of the same company?

 

Also has anyone been taken to court by any of these companies as I'm bricking it at the thought of me in the courtroom?

 

Spreadsheet is already set up to keep tabs on my situation.

Phoned them once, unwilling to set up a payment plan for the amount I can pay so I've just been emailing them daily with my offer. I didn't send them cheques for the original loan as it was all done online. Can you check the stubs of your cheque book to find the numbers then call your bank and tell them the book was stolen and to cancel all cheques that haven't been paid out yet. Not sure if it will work but worth a go

Right toothfairy have been in contact as themselves and NDR.

They're now saying that they'll be passing the debt over to Marshall hoares. From Reading on here it seems that they're also the same company operating under a different name. The email says they'll threaten ccj's and court etc. Has anyone had them turn up at the door yet?

Once Toothfairy have passed the debt onto NDR and they have been in contact its illegal for Toothfairy to chase you for the debt.

 

The OFT rules state only one company can chase you for outstanding debt to stop harrassment.

 

cant say it enough report Toothfairy to the OFT, every other thread on this site seems to be about Toothfaiy at the moment the OFT will have to do something if everyone complains.

Right guys been Reading on here about cca requests quite a lot. Is it worth going down this route with any of my lenders?

I've managed to set up payment plans with cash genie, Pduk, 1ml, 1st stop, speedy dosh and txt loan so far.

 

Starting to see the light at the end of tunnel!

If you have the original agreements then you don't need to CCA. A different part of the CCA Act applies to Payday Loans (Section 87) so you can't go down the default notice and termination notice route as you would with a bank account.

 

The reason for this being that when the loan term has expired (at the end of the month) your contract is automatically terminated as the whole amount becomes due... they cannot charge 'double interest' or anything like it.

 

You should negotiate with them on the basis of orignal loan amount plus one months interest.

Update. 2 paid off completely 6 others on payment plan. I got a voicemail left on my home phone from 24/7 moneybox which my parents picked up. On the voicemail the member of staff reeled off a spiel about me not being in contact despite my several emails asking them not to contact me at home. Parents have hit the roof. Are they allowed to discuss personal details on a voicemail (surely on a home phone that is not allowed)?

Hi - If it helps, I am in default with Wonga, I managed to get this email address, I emailed stating my situation, and together we set up a repayment plan of £112 a month for 8 months. Hope it helps. Also I'm having difficulty with Speed Credit, trading as part of Toothfairy Finance, been threatened with similar Baliffs and Northern Debt etc etc, until you have been to court and had an order against you, noone is legally allowed to come door knocking and taking your possesions, its empty threats. Possibility of taking you to court? Not sure I'm afraid, just keep all correspondence.
