My wife has just been pulled over for no insurance. She does have a license, MOT and TAx, but no insurance. So the car has been impounded and she is about to get a fine and 8 points on her license.

 

The problem I have is that she wasn't aware that the insurance was cancelled. As she has suffered from depression for a while I stupidly didn't tell her that the insurance was cancelled so she was unknowingly driving without insurance.

 

I am willing to make a statement to the police to say it was all my fault and not hers.

 

Would this help at all with the impoundment or the points and fine?

 

Also as we are on low income (only I work) would there be any way that we can pay off the impoundment fee and daily charge.

This doesn't sound good tbh, I think the forces of law and order may say that the car shouldn't have been on the road if you couldn't afford the premiums. But this isn't my specialist subject, hopefully some of the guys will be along later with some advice for you.

Sorry to hear of your wife's illness but unfortunately you cant use ignorance as a defence. If your wife was driving it is her responsibility to make sure insurance is in force. It should be a £200 fine and 6 points on her licence.

 

As for the recovery company they will want paying everything owing before releasing the vehicle. If the car is left there it will attract daily costs after the first 24 hrs.

 

How much is the car worth? if it is not worth a lot it may be in your best interest to sign it over to be scrapped. To have the car returned you will need insurance and any due fee's.

Agree 100% with Esmerobbo i'm afraid. The only thing I can think of which MAY help is that you get some kind of letter from her doctor comfirming her condition. It may get the penalty reduced but as previoulsy pointed out you will need to have insurance in place to have the care released. I think you have 14 days.

Just for info it used to be possible to recover the car by getting someone who had "can drive any vehicle not belonging to them " 3rd party cover to collect it but most new policies specifically say they cannot be used to do this
