      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Anybody from Egg read here because i am royally annoyed!!

 

I have had two letters that must have been packed by someone with dodgy eyesight. Either that or they do it on purpose. One letter i can accept as a mistake but two tells me it is underhand tactics to embarass the recipient and it cant be right! Heres one example below. My complaint is being typed up tonight and it wont be pleasant you g!t$!

We all make the odd late payment! I bet they have a template to fold the letters crooked so it stays like that on its journey!

 

I spent loads at Royal Mint and a late payment meant calls from a so called solicitor from royal mint

But he was someone else really working on behalf of and wanted

my details to verify who I was on the phone and he could have been anyone!

 

My normal answer is you RANG ME so you know who I am, But I don`t know who you are!

Yeah who cares about overdue payments! If you pay on time then sometimes it means they make interest on your money.

 

Million customers then lots of small amounts make a fortune, like BT in advance line rental!

Your envelope is interesting; were it to be stuffed by an automated system, there is indication of a systemic mis-folding and mis-stuffing which puts them on the naughty step.

 

I'm sure things will improve greatly now Diamond Geezer's in charge; I'm already heartened by ARC's cowardice and CSL's incompetence: happy days bro, happy days.

Hi Vic buddy, i think we both know that this is intentional. They have no phone number for me and have little chance of getting one, so my paranoia tells me that because they are forced to write to me this is their form of childish retribution. This must happen to thousands of their customers. I dont care to much now, i have calmed down lol. Big hairy cahunas to 'em!

 

If you are hoping for change for the better Vic then you are a greater optimist than i ;-) I take it you are still being a thorn in their derrière haha. They must surely know by now that they would be foolish to cross literal swords with you.

One must not become egocentric; we are ones of millions not thousands, which is why their systemic folding naughtiness is significant. My Diamond Geezer was borne of ironic pessimism, however one of his goons (CSL aka power2contact) has today threatened me with a doorstep, and I have to say that 97 'phone calls later from me they will not talk to me; I only got through to a person by using the poor2 website number. I know the mantra is not to speak to them on the 'phone but what does one do when they won't speak to you?

 

Anyway, chin up and sod their silly envelopes; and stuff 'em.

I did say it was just my paranoia lol, i am happy with insignificance for sure. Just me having a rant.

 

I feel you are probably in a position to turn defence into attack and perhaps phone them 20 times a day demanding stuff with menaces haha. Right back at 'em ;-)
