Hi there, I was just wondering what happens if you get summoned to court for non payments of a pay day loan?

 

What If you ignore the summons and dont attaend, I mean you cant be arrested for this by the police.

Have you received court papers? if so and you do not enter a defence they will get a CCJ by default. If you do not pay the CCJ they will apply for enforcement which could mean a visit by bailiffs (they will find you!), or an attachement of earnings order.

A CCJ will seriously damage your credit file.

 

you may be moving but the cr ref agencies link address through data supplied by banks, utility companies so it will be with you for 6 years.

 

dont think you can just ignore it and it will go away, you should defend it and im sure you can get good advice on here how to do that.

Pretty much, yes. Also if you are working or claiming job seekers/benefits you can be traced that way too.

You'll probably find in the agreement you signed with them that one of the terms will be that they are able to pass on your data and make efforts to trace you.

Yes but not be able to access my personnal details from my bank, thats against data protection.

 

A company just cant approach a bank and say we want the address and number of such and such without the persons consent who banks with them

The credit ref agencies do not request the info ad hoc, they have agreements with the banks and they forward on a monthly basis details of every customer they have to them.

 

its in the banks best interest to make sure they know all about your credti history as well so every company that uses cr ref agencies agrees to share all their info with them.

 

bugger all anyone can do about it im afraid.

Your bank cannot pass on personal details like your home address or employment details to anyone. Only the police can obtain these details if required.

 

Your bank is only authorised to pass on information regarding credit issues, nothing else.

not going tro get invloved about the legalities of it all but it happens.

 

used to work for a company that looked at peoples credit files, if someone has moved from one address they are found and saerches at other address's by data supplied by banks, utilities, debt collectors anyone that is signed up to share data with the cr ref agencies.

 

with hundreds possibly thousands of companies all sharing this info and the credit ref agencies and them all regulated, I cant see how they would get away with it if it was illegal.
