      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have been trying to set up a repayment plan with them as have found myself in financial difficulties. - I sent them a complete excel sheet with outgoings etc. together with a letter requesting interest freeze and an offer of a small monthly amount which they would not accept - I suggested a higher amount than I had at first offered when I wrote to them - they kept saying it was not enough (£20 a month - my debt approx. £580). They have just taken it directly from my bank account - as that's how it was set up right at the start of the payday loan agreement. I can't pay my rent, I have tried to negotiate in all the right ways and now I am depserate and don't know what to do. I have been in constant contact with them from when I first requested a payment plan and freeze of interest. Can anyone help please - I am depserate!

Was it card details you gave them? If so the only way to stop this happening is to cancel the card,

then set up a standing order for what you can reasonably afford and no more!

Are you working at present, as if you are on benefits you could apply for a crisis loan for your rent.

I did cancel my card but unfortunately they were a DD which I stupidly didn't reember (I have been trying to fend off quite a few creditors) and they're just taken it out - I will cancel it now but feel completely shafted - I have been in constant contact with them and have offered to pay at all times. I just don't know what to do - am at work and feel completely awful and am at my whits end.

I am workking - so no help there - am stuck in the middle, not earning enough but too much to get any help. I have tried all I can to get out of this mess. I have messaged the bank but I doubt they will help.

Hi mb

 

To follow on for Brig's sound advice if however this was via DD get straight into your Bank with your paperwork, explain that they've taken the full amount despite you explaining your circumstances, you're now in severe financial hardship and can they invoke the Direct Debit Guarantee and get a cash back

 

The problem with that as I see it is you agreed to the withdrawal as part of the loan T & C's BUT wrote in advance asking for help

OK Mellowbird cancel the DD straight away and set up a standing order as I said but only for what you can afford

and on a date that suits you.

Don't worry by doing this you will be protecting your self if they do get stroppy, and remember they have no more powers than the postman,

and you are avery long way from any action.

A direct debit can be reversed for any reason (direct debit guarantee), just ring the bank, say you want to reverse the direct debit and if they ask why just say its been taken out on the wrong date or seomthing or its the wrong ammount, the money will be back in your account within 24hrs (I have done this several times without problem), once its in the bank I would suggest taking it out/moving it to another account.

Thank you all of you for your really quick replies - it's massively appreciated. I had no idea a DD could be reversed even though I have requested it - though it was just onj the off chance and I wouldn't get it. Thanks so much! I will obv. cancel the DD and set up as you say. Some creditors have been OK and am paying them - these people have been hell. I realise at the end of the day I only have myself to blame but believe me I did try all alterrnatives before going to them. I will remember NOT to write for help before checking DDs in the future - I feel so gullible. Thank you all of you for your help - will post back when I have an answer.

Thank you so :oops: Have just spoken to the bank - cancelled the DD and they're putting the money back in - had no idea it was that easy with a DD. You chaps just made me very happy. Thank you.

They would be stupid to do so when you have set up a payment scheme, they perhaps,

will threaten and posture, but it would be very unlikely that any judge would order you to pay any more.

They have no powers whatsoever so don't worry, any letters will be full of phrases such

as we might, we may etc.

Just Empty threats.

They will puff out their chests scream/shout/bleat and throw their toys about but realistically they can do very little, they rely on fear and lack of knowledge

 

The next step is for you to take control by telling them how much you're going to pay based on your I & E (That is none of their business by the way)

 

I wouldn't even go for £20 I'd start at £5, pay by SO only and as long as you make these payments they wont go anywhere near a Court as the Judge would take a very dim view due to the effort you're making

 

Do everything in writing so you have a paper trail

Thank you - I have it all on email and have refused to call them at all - I cannot make outgoing calls on my mobile and can't call them from work. I did try a lower amount but they wouldn't have it - so I can just set up a payment anyway? I shall do that and stop trying to negotiate with them, as they clearly won't negotiate! You have no idea how much you chaps have helped - thanks so much. I look forward to the day that all this juggling is over! :whoo:
