Thanks Unclebulgaria67 I guess I will just have to suffer it until I get a definitive answer from someone within our government! I do so hope this is not happening to anyone else for much larger amounts as this can and possibly will become exhausting and crippling to the pocket without recourse... Regards

Bless you thank you so much . I don't think they really had a clue what was going on I just feel sick that they may think I was a shoplifter as I put the things in my bag rather than a basket....it was a substantial amount of goods so surely they wouldn't think I'd be that thoughtless or blatant about it. I'm just petrified that the police will come knocking for a genuine misunderstanding B -

Good Morning, there is nothing on the reverse of any of the paperwork sent on the 17th January and that looks like all the paperwork that came with the case file, I am more than happy to scan every sheet but it only contains "Ways to pay" or "Financial Statements". I did not see any paperwork on appealing the PCN. pdfjoiner (2).pdf -

You have nothing to worry about. I'm quite sure that they are so busy dealing with their customers and with Covid et cetera as well as all the security problems – that if they don't have your details, they won't go to any further trouble to obtain them. If you want really to cover yourself in full transparency then you could write them a letter and explain very carefully what happened and that you are sorry if you've caused any trouble. That way you would at least have a paper trail to establish your bona fides in the matter and you might feel calmer after that. However if you did decide to do that then I don't think I would talk to them about the fact that you are a military wife or a teacher et cetera. I would give them minimal details other than the facts of what actually happened. Also it seems to me that they haven't lost anything. They don't have your details and obviously they let you go and it seems to me that they may well have accepted what was happening because otherwise I'm fairly certain they would have tried to stop you. You are best off forgetting it. I'm sure it must have been a very stressful moment. I hope that your child is okay

Sorry for only updating you now, but after your guidance with submitting the claim it was pretty straight forward and I didn't want to unnecessarily waste your time. Especially with this guide you wrote here, so many thanks for that
So I issued the claim on day 15 and they requested more time to respond.
They took until the last day to respond and denied the claim, unsurprisingly saying my contract was with Packlink and not with them.
I opted for mediation, and it played out very similarly to other people's experiences.
In the first call I outlined my case, and I referred to the Contracts (Rights of Third Parties) Act 1999 as the reason to why I do in fact have a contract with them.
In the second call the mediator came back with an offer of the full amount of the phone and postage £146.93, but not the court costs. I said I was not willing to accept this and the mediator came across as a bit irritated that I would not accept this and said I should be flexible. I insisted that the law was on my side and I was willing to take them to court. The mediator went back to Hermes with what I said.
In the third call the mediator said that they would offer the full amount. However, he said that Hermes still thought that I should have taken the case against Packlink instead, and that they would try to recover the court costs themselves from Packlink.
To be fair to them, if Packlink wasn't based in Spain I would've made the claim against them instead. But since they are overseas and the law lets me take action against Hermes directly, it's the best way of trying to recover the money.
So this is a great win. Thank you so much for your help and all of the resources available on this site. It has helped me so much especially as someone who does not know anything about making money claims.
