I have an MBNA/Abbey card that I took out in either 2000 or 2001. I had run up a a considerable debt of around £8k. I was made redundant in 2008 and the card's insurance made monthly payments between Sept 2008 - May 2009 (i had found work).I am still continuing to pay the outstanding balance which now stands at £4k but was wondering if I could make a claim? Any advice/help would be appreciated.

There's another thread round here somewhere wher someone asked of they could claim after they had received a pyout.

 

The answer on that thread was yes you can and just deduct the amount you were paid out from the amount you're claiming back.

Sorry Pete, was a bit unclear wasn't it?

 

Make a note of every premium you have paid to them and the date it was paid. Work out stat 8% simple int on each of them. Add those payments and the int together. That is the base of your claim. Then deduct the amounts they paid yout when you were claiming from the policy.

 

The result is what you claim back

You need establish if you have been mis-sold PPI, but you will also need information from the Credit Card provider.

If you have been mis-sold PPI, remember to claim back compounded interest as Restitution.

I was thinking. Shall I initally write requesting when i originally took out my card, a copy of the T&C, and some statements? (since i made my insurance claim which they covered from Sept 2008 - May 2009, total payout to MBNA from the insurers was c.£3920, I no longer am been paying insurance as they have reduced the interest rate.) should i still proceed a claim from the period of taking my card up until August 2008 then minus the amount paid out? Not sure.

As rebel1 says, first establish if you have a valid claim. On what basis do you think you were mis-sold ppi?
