    • I would have thought so but I'm no lawyer. What did the one that you spoke to say? You could also google about how/when a will trust is set up to get more of an idea before you speak to the original lawyer. HB
    • While I am waiting for the original solicitor to ring back about the will can I ask. After my dad passed they were informed about this an released a copy of the will to me and my brother, should they have set the trust up then as they were informed of his passing?   Thanks again

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

OK, I've amended the statement to £100 per month towards the arrears. Given your circumstances I think you'll be OK with that. I have also put in the statement that you are querying the amount of the arrears.

 

When you print it out make sure your printer is set for A4 paper (not Letter size) so it all stays on the one page.

 

You need to get it to the court asap (the fee will be £35.00 if you have an eviction warrant).

Just one last thing, I got a letter from their solicitors today asking me to contact them urgently, it may not be too late etc...

 

Is it worth ringing them and telling them what we are offering in court?

First thing tomorrow morning.

 

I was waiting for my WTC confirmation letter that was due to arrive today (and did AT 3PM...Royal Mail!) so I can take all the evidence with me tomorrow AM.

 

I am thinking they may well list me for Friday/Monday.

 

Do you think I may have a chance of striking a deal before we enter the courtroom if I call them?

Three things...I know you are busy so I do not wish to add more work onto your full plate so these are for reference (or reply if you have time)

 

1 Hearing is set for Monday 2pm

2 Mortgage company have rang me today and told me to fax them my request again regarding switching to the variable from fixed rate (saving me £700 on my cmp) AFTER I told them I had submitted an N244

3 They also said that if we went down the mortgage rescue scheme, if we provided proof we were going for it (wifey pregnant & me disabled so we seem to meet the initial criteria) they would put everything on hold.

 

So, I will fax them the letter regarding the rate change...why they want this again after saying no, I am confused...and also with the MRS, should I keep that up my sleeve incase the judge does not rule in my favour?

Hi Guys

 

as the day of destiny draws closer I am getting seriously stressed...with a mind full of what if's.

 

Just one last point I need clarifying Ell if I may...

 

I have checked and double checked the MRS criteria and we seem to fit, if all goes pete tong, do I mention this AFTER the judge has said his piece of before?

 

Also, should I go in with one of the money advice guys that sits at our CC?
