      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi yesterday my pc started to do something strange. It just switched itself off then when I restarted the screen was just gray and my mouse pointer was huge but there was nothing to click on. I restarted again and all was fine. It did this about 3 times. Anyone know what might be going on? cheers. Paul

Could be a multitude of things. I would start making sure it's not a virus. Download this (free):-

and perform a quick scan. If there are infected files, then you can get it to remove them for you.

 

As antivirus programs go, I prefer Avast (free) for real time protection. Also Microsoft SEcurity Essentials is getting

some good reviews.

 

If it's not a virus problem, we can then look at other things.

If it's found 3 infected items on a quick scan, then you would be wise to do a full scan now (takes over an hour though).

Several Reasons could be the factor...

 

1) Your Hard Drive/CPU/Video Card are Over Heating, and your computer is shutting off for SAFETY. Solution: More fans/Cooling of some sort

 

2) You are pushing too much hardware for the power supply you are using...I.e. you have a 300 watt PSU and you need a 350 or 400, depending on what hardware you are using. Solution: Get a bigger Power Supply

 

3) Something on the motherboard is shorting out, causing your computer to shut off. Solution: Check all connections and make sure nothing is touching the motherboard, that shouldnt be.

Between 70-90 degrees is quite normal for most processors.

try this. Go to control panel, system,startup and recovery,settings, and uncheck the box auto restart.

 

hopefully you will receive an error message and a dump file before the next restart.

Took a look inside last night. Nothing touching the motherboard. The psu is 250 watt. I'm obviously not an expert but this seems quite low. Though I have not upgrade or added anything to my pc and I've had it a couple of years now without any problems. Now, the cpu was totally covered with dust. It was so thick couldn't see the fan. I got the hoover on it and got as much out as I could. It's now running at 48-49 degrees. I'm just waiting to see if it will switch off again.

Sounds like its running a bit hot, it will shut down at certain temperatures, I'd try and get it a bit cooler, have a look at the main cpu fan/heatsink, they are often full of dust. You can buy better fan/heatsink assemblies quite cheaply, you just need to know the cpu type.

 

Also maybe invest in a push-pull case fan arrangement, one blowing, one sucking, Maplin do a good range, although avoid their own brand cheap ones as they are rather noisy, keeping everything cool will increase the life of all your components and is a must if you are going to do some 'overclocking'.

 

Have a look in Event Viewer > System after a crash/reboot this may give you the reason.

Well it seems more stable now. No switching off and it just feels a bit quicker all round. Also, I can hear the fan again. Never noticed that I couldn't before. Thank you so much for putting me on the right track. cheers! paul

PSU is low wattage tho for a dual core.... if you do things that use a lot of power (Burn CD's for example, where the hard drive and CD are both running) whilst also playing a game (that pushes the graphics card) it may cut out (or go BANG even)

locutus - really? so it would be worth upgrading the psu anyway? I was planning on upgrading my graphics card soon so I'm thinking it would be wise to upgrade the psu before I get a new graphics card?

Upgrading the graphics card.... I take it you like playing games on your PC. Personally I'd upgrade from the 250w PSU at the same time as may high spec graphics cards need a dedicated power feed direct from the PSU (and I doubt a 250w PSU will have one.)

 

I've built budget PC's for years, and I havn't seen a PSU below 300w in a long long time, and never on a dual core system. Are you sure this is only 250w?

Apologies. Just double checked the psu - Input 300w, Max output 250w. Does this make a difference? I have an old xp tower unit from about 5 years ago. The label on that psu says ATX-500w. Is this okay or would I need something more recent? thanks.
