    • Thanks Dave It's not too far away, about 8 or 9 miles, I will probably venture over on my bike if I can't think of a good reason to drive there again! I'll have a chat with Mrs GB_Joe tomorrow and see which shops they visited, I know M&S was on the list (had to try on multiple sets of trousers!) and they are actually in that bit of retail park. The uniform shop is across the way in the Meridian Centre, so probably not helpful to get them involved.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Ok AQ filled out and copies of original charges and accompanying letter telling them I am claming interest per day has accompanied this as well.

ive just checked and clydesdale have sent the defence - but no witnesses

 

Anyway

 

Today I received the following

 

Thank you for your letter of 6 November 2006 advising that you have not accepted the cheque issued in full and final settlement of your claim.

 

I would advise that the banks position remains unchanged from that which was stated in our final response dated 27 October 2006.

 

I trust this clarifies the banks position.

Still heard nothing from our freinds, however Blackpool County Court have banked my cheque yesterday.

Good Morning.

 

Just got home from Old Trafford after watching my team get spanked.

 

Anyway, got a copy of Clydesdales AQ that they have sent to Blackpool Court.

 

They have ticked the Yes box to have it extended for one month so that they can attempt to settle the claim by informal discussion or alternative dispute resolution.

 

They have agreed to keep it at Blackpool and also keep it Small Claims.

 

They have entered 2 witnesses as well according to the AQ and all signed by my lovely freind Kirstie Ross.

 

Anyone else had this form back any different or is this "standard issue"?

Oh dear Hoogie - as a United fan I don't feel your pain:p :D .

 

OK sorry I couldn't resist. Blackpool County Court Clerks have been telling me fibs on my Woolwich claim (It has/has not been before a judge yet) when I know it has - the reality of my situation is that it has just been waiting to be typed up for 4 weeks, and my AQ has been in for 10.

 

I hope you don't have to wait that long, but when you talk to them be mindful they may just want you off the phone.

Nothing from nobody, KAR has completely ignored the letter I attached to AQ, I'm personally not expecting anything from the court for a good while yet:rolleyes: as I've already dealt with them. Don't ask me though I am a bit of a pessimist when it comes to Blackpool CC!!

 

Don't worry - your day will come and it will taste even sweeter when YB cough up:D

Hiya, did you get all your charges back. I have just received a cheque for about one third of the amount I was claiming back. The letter was from Neil Mckirdy, I am going to send them a letter saying I am refusing this offer, how long should I then wait??

Ive refused an offer of about a 3rd. Ive received nothing back yet Micky. Read through this post and you will see how it pans out.

Just about the same as ours,except they asked for the stay on 3rd of dec.So time nearly up and not heard a thing.So much for them wanting more time to reach a settlement.Just another delaying tactic and more obstructive behavior.Still it wont look good for them if we ever step into court.

I am hoping I'm wrong with this post as it would be a nice start to '07.

 

The way i've read the situation is that BCC will put it before a judge when they get around to it, and then the judge will decide whether or not to grant thier pathetic little request. If he/she does (most likely) then the stay will be granted for one month:x .

Hi Hoogie,

Just a quick question if I may, do you live in England? I'm at the issue stage with Clydesdale but not sure if I can use the English system or not (i think not) and would appreciate any help. If not, I think I'll have to isue through the Scottish courts and use multiple claims.
