    • Okay please go through the disclosure very carefully. I suggest that you use the technique broadly in line with the advice we give on preparing your court bundle. You want to know what is there – but also very importantly you want to know what is not there. For instance, the email that they said they sent you before responding to the SAR – did you see that? Is there any trace of of the phone call that you made to the woman who didn't know anything about SAR's? On what basis was the £50 sent to you? Was it unilateral or did they offer it and you accepted it on some condition? When did they send you this £50 cheque? Have you banked it? Also, I think that we need to start understanding what you have lost here. Have you lost any money – and if so how much? Send the SAR to your bank as advised above

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Now obviously I'm not going to call them, and I have no idea what this relates to.

 

It is in no way 'urgent' by my definition!

 

Curiosity took me to their website and they apparently expect you to set up an account furnishing them with a great deal of information in order to contact them.

 

What I need is an email address for a telephone harassment letter. Because one call is one too many.

 

I have no idea how they got my mobile number as my alleged debts are fairly ancient and predate my mobile phone?

Okay sent email from throwaway email addy without my name on it, only point of reference their reference number and the number they are texting; didn't supply my address as they may well not have it.

Wait for a letter then... You may get a few more texts and phone calls before that time though because you've now established that you're someone they're looking for; linked to the mobile number that they have. Just reject the calls and delete the texts.

I finally received a laughable threat letter a couple of days ago, 'further action' if I do not pay immediately.

 

Just adding a few more emails for 'Freds.' I like to create a public record of anything useful!

 

These three all sent me a 'not read' receipt in response to my BOGOF email marked FAO Compliance Department. (says it all really doesn't it)

 

Thanks for providing me with your email addys guys :) and even more thanks for confirming 'Freds' aren't interested in compliance.

 

Turns out this is an ancient 'Simply Be' Account, with an outstanding CCA request since 2008.

 

You can tell it's a new tax year can't you...

 

 

And finally a letter received confirming they have 'removed the telephone number from our system as requested.'

Yea I got loads of those "your email was deleted without being read" from freds, and their pet solicitor who's email are also not read by Kay et al @freds. They have a lot of people called Kay, Bridget, and jackie they also have a special email address for disabled people so that they can have their emails deleted without being read.

They cannot be bothered to read your e-mails, so don't send any more. If they ring you do not answer any security questions and if they keep ringing you purchase a loud whistle. Wait until they send you something by snail mail that gives you the full details of the alleged debt. Then and only then reply by mail.

They have already sent me a snail mail letter and I responded with a comprehensive 'go away' via email. Over a period of several days an ever increasing number of 'Freds' people claim to have not read it, for an unread email it is certainly doing the rounds!

 

They also got blasted after the first telephone call and have written to me to confirm they will not call me again.

 

I am simply awaiting their next written contact so I can refer them to my allegedly unread 'Final Response.'
