      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Im currently going through my re-claim with Barclays, they intitially offered me half the amount I am claiming. I sent a letter to them explaining I would take their offer only as part settlement and if they did not respond within 14 days I would instigate court procedings.

 

I received a letter back from Barclays in response to this stating they would not offer further monies and that this is their final decision.

 

From the letter it appears they are prepared to go to court...

 

What do I do ????

 

Take the money or go to court??????

 

Any help or advice is greatly appreciated.....

I am sorry but I am unable to help you but I am just informing you that they have done exactly the same thing to me! Every other bank seems quite adament they do not want to go to court except Barcalys! Any help on this matter would be great. Thank you

A letters one thing but have Barclays actually taken someone to court yet?

I thoughth the whole scare factor within reclaiming these charges is that if a bank goes to court and loses then the press would advertise open season for all disgruntled customers.

i had the same leeter from barclays, why are they so confident.its obvious they will have top solicitors working on the case.im worried and might just accept offer of £100 and run, rtreat myself and that be ned of it, good luck

If you take a look through some of the other forums you'll find a lot of other banks will not budge on their opening offer (if you even get an offer).

They stick on these grounds because it does scare people and some people will just take the offer and not go any further.

You should count yourself lucky you even got an offer! :)

 

It's entirely up to you what you do, it's your money, im about 89% sure it will not go to court, they'll back out at the last minute and pay you the full amount. However as the site states, do be aware that your case might end up in court, it's not a "get rich quick scheme".

 

If I were you I would continue with your timetable, take it all the way, you will get all your money back, you just have to be strong and confident in what your doing, if you've followed the steps detailed in this site you shouldn't have any problems.

Hiya, I'm not taking on barclays but I think if you have a look through some of the threads in the barclays bank forum you'll probably find that this really is just standard scare tactics and that barclays are paying out in the end!! have a look through, especially the cases where us little people have won and try and get some reassurance.

I have recently turned down my offer from Barclays and they have said they will only settle with that offer and nothing else. Does anyone know what letter I send back to the bank giving them 14 days to comply to my complaint before I go to money claim court?

Hi

I have also had a letter back from Barclays offering me about 1/2 of what I was claiming for, and am also not sure whether to accept or not. With all the time it is taking, i think I have had about another £90 added to my account in charges, so really want to try and get it all back including what has been occurred since starting this.

 

Has anyone threatened to take them to court, but Barclays have given in at the last minute and given them all their money back?

You should read the Barclays bank forum, and the litigation forums for what other people have done, are in the process.

 

To my knowledge, no bank has gone to court yet.

 

You really should take a good read through the forums properly, you should have done this before you even started the process.

I have my Barclays court hearing on November 2nd. Am I worried? Like hell, I am! :-D

 

Jodie, clhtyler, PLEASE don't give up, and don't let them get away with half, it's exactly what they want you to do, and Barclays are even more hard-a**ed than the others... But guess what? In the end, they PAY, just like any others. They just take longer.

 

Top lawyer? :lol: Have a look at my Barclays thread, and the defence they posted. They can't even set their keyboards to type properly or finish sentences... Yeah, REALLY scary.... :-D
