    • if i remember rightly, long ago in one of the first drafts of the old proposed gov't overhauls, there was a listing of recommended 'charges' that inc wrong reg = £20. some PPC's implemented such changes in advance. then later as it looked increasing likely the new code was never going to be implemented after it's 1st review and another set of codes was to be debated they all quietly revert back .......... dx

Sorry what is the different between a default notice and a default cal marker? yes, i may try and work arrangements out with the OCs after the breathing space but I'll see my circumstances then thank you again for all your help and patience, I really appreciate it and apologies If i am too fast or repeating myself.
    • receiving a default NOTICE (forget simple default cal markers) does not mean it will get sold on... OC's very very rarely do court themselves.  if it does you would receive a Notice of Assignment from the debt buyer/DCA.  as for reduced payment if it remains with the OC and they issue a DN, no harm in trying but lets get all your ducks inline first. dx  
    • okay thanks do you know how long it will take for it to get to the DCA or could the OC try and issue a CCJ? even though it's unlikely also for example would the OC agree to a reduction and a small payment over a super lengthy period of time if agreed? Rather than go through chasing apologies again for all the questions, just trying to understand all the possible scenarios.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have sent off for a Barclays account and been accepted so waiting for all the info to arrive and cards etc. Is there anyway i can stop them taking money like a template letter. I do have another account with a diff bank so on payday i just transfer the money to that account minus dd that go out. I'm paid weekly so is a bit easier.

Seem to be ignoring my emails now, no reply. I also told my husband he said i was silly but we are ok and will get through it so pleased about that. Also asked my bank for a new account and should be sorted in a week or so but my card has been cancelled to my account. So once new cards and new account is set up will swap bills over to that one.

Yes i can do when it arrives. They also stated £400 is due on the 21st April. So i'm guessing the statement of account will be the £400 loan plus the 2 x £80 i paid to defer.

 

I emailed every address i had for every person who had replied to my 1st emails. This email the subject said We have received your emails lol so think they got fed up of me emailing them all day.

 

Also sent this person my repayment offer of £240 to be cleared in may. The loan was £320. £80 interest so £400 in total. Paid 2 x £80 so offer £240. If they keep declining this i will wait until they pass it on and then they can get £50 a month.

 

Trying not to let this get to me, i am pregnant and not been an easy pregnancy so far. Have been told to relax so want this all sorted asap

Thank you for your recent email and your request for a repayment plan.

Our accepted criteria for a repayment plan is as follows:

Severe Disability or illness

Imprisonment

Terminal illness or Mental illness

Deceased

Redundancy or Reduced hours (contractual hours reduced by company)

If your financial circumstances have changed due to one of the above, we would be able to consider a repayment plan, however it would be on the current balance of £400.00.

We will require you to send in bank statements and wage slips covering the last 2 months to show that you are now in receipt of either financial support or a reduced wage. If you are now unemployed we will also need to see proof of unemployment or redundancy. Alternatively if your circumstances have changed due to personal illness we will require evidence in the form of a doctor’s note or hospital letter, as well as the bank statements.

Please be advised that if you do not fit the above criteria or you are unable to provide documentation, a repayment plan cannot be considered.

Stressedx Try an think of yourself offloading some of that stress by posting on this thread. There is no rush to get this sorted, you can only pay what

you can pay, when you can pay it. Dont let them put you under pressure. There are people on here that can help you through this and support you as well.

They like to rush you and make you think something worse will happen.

 

Just take your time dealing with them, think of it as breathing exercises at baby class. You and your babies health are more important than a few hundred quid which will be sorted one way or the other.

If a customer wishes for us to consider a repayment plan then they must provide the documentation that we request. I have noted the fact that you will not be sending this in, which is of course your right entirely.

We therefore will not be agreeing to set a repayment arrangement on your Payday Loan, and we will not be “wiping this debt off”.

Your loan will therefore fall due for repayment on 21st April 2011.

Have you done an i/c and expenditure sheet for yourself stressedx to see how much you can actually pay them per month without getting

yourself in any other difficulties ??

 

Also I would think your personal financial circumstances have changed since you became pregnant and will do more after the birth of littleun

maybe they will agree to a repayment plan if they knew about you expecting as it may creep into their criteria for a repayment plan.

 

Also you could consider allowing a judge to decide how much is actually owed and how much you are reasonably able to pay. You could end up with a ccj

mind you. Personally my credit rating is bombing anyway so a ccj wont matter to me, but may to you. Bear in mind, going to court could take months

giving you a chance to save up enough money to pay them what a judge agrees you owe, and if you pay the amount within a month of the judgement,

you do not get a ccj. Indeed the judge may rule that you only owe half the amount claimed by PE.

 

OR before you actually go to court but after the summons, bearing in mind the amount claimed by PE

you could make them an offer. Also remember that once and IF PE go to court the amount claimed usually stagnates and doesnt increase.

I'm hopeing it doesn't get that far. I can afford to pay payday express £240 in May but they want charges and whole amount paying. I'm in a debt plan with cccs for other debts so credit history is rubbish anyway. Was hopeing once they pass it on i could arrange a final payment with the dca. I will save what i would pay them anyway so if they settle i can just pay it off. I will be on maternity pay so is 6 months normal pay then anymore time i want off i don't get paid. I will mention i am pregnant but from what they have been replying there not interested.

 

Do the dcas accept payment plans, hopefully by the time it's sorted out i can pay them 1 amount to wipe it.

 

Scared about the whole going to a judge etc.

DCAs usually accept plans and you may find that as they bought the debt for a smaller amount the would also be open to offers less than the amount owed.

Dont be scared about going to court as they will be fair to you and will only agree a payment that you can reasonably afford according to your income and expenditure.

I have been to court before and been successful in reclaiming bank charges, it was fun.

They have said they have sent me a letter with all the info on. As it's not due to be paid yet will be

 

Loan £320

Interest £80

2 x £80 defer fees i have paid

 

Don't want them ringing my work so told them no to but will see if they listen to this. Was going to offer them £50-£100 a month each so will save that. Would of been nice to pay PE off next month but their not interested.

Your are stressing for no reason, its only as big a deal as you make it out in your head. Stop letting them bully you, if theyr not accepting your very generous offer, ignore them, thats what i am doing.

Pay day express can go to hell . Ill wait till they pass it on to a DCA and ill pay them 20 pounds a month.

 

I spent 6 weeks offering them repayment plans, and gave them an I/E breakdown, this is far as I was prepared to go, I am now ignoring them. They keep sending the same email over and over again. Im not losing any sleep over it. You shouldnt either.

 

You will only ever get to court if you refuse to pay ANYTHING to them or the DCA, you are clearly not doing that, even 10 pounds a months when it goes to a DCA will mean they cant take you to court because the account is in payment. That is the bottom line, relax, and stop feeling so guilty, its only money. :0

Sorry not been on been a bit hectic.

 

I'm not worrying about the loan it's that my wages go in Thursday and they will try and take £400. Had confirmation about my new bank account but no account details yet and is too late to tell my work anyway. So just hope cancelling my card stops the payment going through or i'm stuffed

Yes, keep offering them money, they will not have any room to move as long as you keep offering and they keep refusing. By now you would have made two payments to them (but they don't see it like that!) and have greatly reduced the debt!

 

If you can keep the money to one side it would be useful if it goes to court as you could offer the original repayment as 'surety' on your defence and then argue the charges/fees/interest.
