      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi everyone!

 

just like to say thanks for all the hard work you have all put in, the info in here is brilliant.

 

ive just sent off for my statements but i have one question to ask before i send the full amount for them to cough up!

 

i do not have an overdraft does this mean that i dont charge 8% apr on the figure as all my charges are direct debits not going through ?

 

sorry if this is a bit simple but a bit nervous and want to get everything right!

Don't worry about the interest for now, as you can't claim this until you get to the court stage, at which point you charge 8% per charge, which actually adds up to be quite alot of money!

money claim form ( with interst added on)

 

is this correct or do i add intrest on the LBA letter)

i know that you dont put interest on untill money calim but when i send my breakdown of charges in should i "hide" the intrest cell in excel or let them see it ?

That depends wether your talking the 8% interest or the interest that they have deducted from your account when they took out the charges.the 8%,the final page isn't used till you take them to court but you can show the interest that has been debited from your account for being in the red.Hope this makes sence.regards Nigel

Yes send it recorded then they have no excuse that they didn't receive it.I sent mine registered leave them no chance of escape.Marquez thinks I'm lying about my claim see my thread we won.don't know why.does the info I have given give you hope?Regards Nigel

so many address found on here to send to halifax but could people please tell me where to send my prelim letter,

 

looking at it it seems as if leeds is the best place as the trinity road in haliafx has different postcodes to parts of the building just want to make sure it gets sent to the best place!

Got offer 0f £420 for a 1600 claim, seems as if halifax a offering a bit more now ?

 

LBA sent and getting ready for money claim ! what to write please could people please post what they wrote ? plus ive noticed you have to send documents in? what are they and is that only after halifax say they are submiting a defence ?

Sent my LBA on Monday 2nd.

recieved a letter stating that they would not pay 6 years of bank charges and if unhappy go to the ombusman.

Spoke with halifax this morning and said as far as they are concerned matter is over . see you later!

 

My question is do i have to wait the other 7 days until going to money claim or because matter is over by them can i go to money claim now ?

couple of queries on money claim form if any one can help!

 

i dont know the exact date / year i opened my account, i know it was either 1996,97 or 98, does tyhis matter ?

in the amount claimed box that is the charges + the 8% interest ?

 

and the daily interest you put in is that just the charges x 0.00022 ?

i dont add the 8% to charges there !
