    • Hello   Not a legal issue as such but wasn't sure where to ask advice on this.   I have just been awarded £2050 on a PPI claim.  I went through a claims company so i expected to pay them 40% plus VAT of the claim won.  However, i am querying the quoted court costs (which i was not informed about prior to this).  They are quoting the following court costs: -   £205 - Court Issue Fee £335 - Court Hearing Fee   I am no legal expert but these seem very high for such a small financial claim.  I will be lucky to see £500 of the initial £2050 if this is correct (yes i understand the 40% i could have avoided if i didnt use the claims company).  If these costs seem realistic then no probs with agreeing to them but if the claims company artificially inflated these for their own gain i would be none the wiser.     Can anyone advise please?   Thanks 
    • Our general hospital uses a similar system, but I don't think(?) it displays all your personal details for confirmation at the end of the process.  In fact I'm pretty sure that at the end of the process it displays only the last three or four digits of your 'phone number and you must confirm that this is correct.    Also at my GP's surgery it only asks for date and month of birth together with the initial letter of your surname and then it displays "Thank you.  You are recorded as attending".   I would say what you describe is a sort of breach of data protection, but not sure how serious it might be.  (I can see no valid reason for displaying full name and address etc if other hospitals' systems don't).   Go to the website of the NHS Trust in question and see what their complaints process is.  There may be two different processes: one for "general complaints" and a separate one for data protection complaints (eg direct to the trust's data controller*).   Personally, I would complain down both routes.  Don't, whatever you do, get diverted down the PALS (Patient Advice and Liaison Service) path as they won't be equipped to deal with this sort of issue.   As a former NHS manager I'd be interested to know what sort of reply you get.   FWIW I'm surprised(!) the ICO suggested complaining to the GMC as they won't be interested.  This isn't a medical staff issue - it's a trust data management issue.  (I'm really surprised at the ICO's suggestion on this - it's bonkers!).   *If you can't find out how to contact the Trust's data controller from their website, ring and ask them.   EDIT:  I wouldn't allow people to "shoulder surf" me.  Our trust makes it clear that people behind you have to stand behind a line so they can't see over your shoulder.  If anybody was standing directly behind me I would "politely" draw their attention to the notices and "ask" them to stand back.  If your hospital does not make this clear, that's another complaint...)

I have been looking at the pay day loan forums for the last few months as like many of you I've got myself into terrible problems :|

The main issue I have had has been with Minicredit, who are incredibly difficult to deal with. I have had an outstanding balance with them since September last year and now the total amount I owe is over £1000.

From looking at previous posts from other Caggers, I have seen that Minicredit do not negotiate with debt management companies (I am currently in a DMP) and are quick to issue CCJ's.

Now the last letter I had from them was stating that it was the final chance to pay before they started legal action. I had manage to come to the agreement with them that I would pay the original loan amount and original interest which was about £520 but explained that I couldn't pay in one go.

They then rejected my offer to make 4 payments to total the £520 and since then they have gone quiet.

I was preparing myself to receive the CCJ when I get a call from Fredericksons debt collection agency saying that they are acting behalf of Minicredit and did I now want to make a payment. I explained to them that I was in a DMP and gave them contact details of the company and they haven't bothered me again since.

Now I am wondering if Fredericksons are going to try and take me court instead?? My DM company said that they negotitate with them all the time so they are likely to accept the repayment plan but this all seems completely out of character for Minicredit given the way they are known for behaving.

Has anyone else had a similar experience in that Minicredit have sold the debt on and you've been able to negotiate? I'd be really interested to know!

Hi Margot, received a court summons from MC 7 Jan 2011 Chose to defend as didnt agree with total owed and other things ;)

Have you received a hello goodbye letter from Minicredit and Fredricksons.

Do you agree with the total amount owed??

Was the account in dispute before MC handed it over??

Yes the account was in dispute before it was passed to Fredricksons. MC did accept a reduced settlement figure but wanted the payment in one go which I couldn't afford to do. The last letter I received was from MC saying that it was the last letter before legal action. A few weeks after that letter I started receiving calls from Fredrickson's who said they were acting on behalf of MC and told them I was on a DMP.

I've let my DM company know that the debt has been transferred too and now it's all gone very quiet.

Maybe everything is ok and I should stop worrying??

i got a loan of 100 pound in may which i got 80 pound i referred it in june july august september october at 40 pound a time thats 200 they have had back allready i went to defer it in november the 7th the day before the due date and baecause i changed my address i hadnt updated my minicredit account with my new address for my bank card so they wanted full payment of 155 which i didnt have till the weel later just checked my account now and there saying they want 571 that 400 pound interest in 6 weeks thats like a tenner a day

Are you saying they won't accept your proposals for repaying? Then YOU ignore THEM!. If they send someone round dont let them in and dont even talk to them. They wont take you to court as it is too costly but if they do then your defence is they ignored reasonable proposals. But the more you ignore them the least likely they are to do anything.
