hi

i hope someone can help me i have a mortgage with spml (acenden/capstone) i am currently paying my arrears along with my monthly mortgage payment which is 600.00.

it all started last year when my wife developed gall stones and was off work for 8 months the mortgage company was getting what little money i had left after gas electric bills etc.

i got a eviction notice and wanted to co-operate with them and come to an arrangement however i had to put up a lump sum of 1500.00gbp and then 600.00gbp every month i paid last month and was late by 2 days which meant i got charged 115.00gbp and this month the payment was due on the 15th (which is what they wanted not me) i havent payed yet as i only have 300.00gbp in my account i was looking on this forum about a SAR

i would like to claim back my arrear charges as i bet they will be 5k + i would like to know how i can proceed with the SAR

do i need to write them a letter?

how much do they charge?

sorry for the newbie questions but i am at my wits end with this dreadful company

Hi tla105 I am fighting these people for my charges they are horrendous to deal with. Send the SAR as advised they will refuse your request for a refund but as soon as you get their final response you can contact the Ombudsman. They seemed to treat me with a bit more respect once the Ombudsman was involved.

I actually phoned the Ombudsman before I got my final response and although they couldn't take the complaint on at that stage they did right to Acenden. Good luck don't let them get you down!

they should be coughing a lot easier now:

You must not make any complaint through the Ombudsmanlink3.gif. your time will be wasted, you will wait up to 2 yrs and there will be a minimal 8% award of interest and no account will be taken of any other damage you have suffered.

You must make your complaint through the county courtlink3.gif for a rapid and effective remedy

Hi

Welcome to The Consumer Action Group.

I am just letting you know that as you haven't had any replies to your post yet, it might be better if you post your message again in an appropriate sub-forum. You will get lots of help there.

Also take some time to read around the forum and get used to the layout. It is a big forum and takes a lot of getting used to.

Once you start to find your way, you will soon realise that it is fairly easy to get round and to get the help you need.

It can be bit confusing at first.

Please be advised that my time will be limited for the next few weeks. Thanks for your understanding.
