Please help!! Accused of benefit fraud!!

I recieved a letter from the council asking me to attend an interview under caution as they think I have lied about my partner living with me.

 

He moved out last May as we seperated. I claimed help with council tax & rent as only working part time. This was all fine but now they all of a sudden don't believe me, nearly a year later! My Ex has not had a perment address after having to move out of his parents house last Nov, and currently lives with some friends. He has not changed his address with his bank etc, and even though I keep asking him he won't untill he gets perment address for himself. I am assuming this is the evidence they have. We did change his council tax bill address to his parents at the time though, so they must know this?

 

He does spend every other weekend here to have his time with our child but sleeps in the lounge and mostly I spend that weekend away. He also, if not working, will look after our child when I am working, in the house as he has no-where else to go. Anyway, I know there is not any time limit law on how many nights he can stay.

I don't do his laundry or cook for him but the council won't know this unless I tell them or they visit the home. We are 100% not together but what can I do to proove this?

 

What can I do to show he does not live here and has not since last May? I am asking him to write a statement explaining why he has not changed his address and still uses it for correspondence etc and thought maybe to get a statement from my neighbour.

So is his bank still registered at your address? What other paper work is registered there. The investigators can get his credit file which will show everything. Of course they still have to prove he lives there.

 

I was with some one the other day at an IUC and that was the only "evidence" they had. Do you have anything to prove his where abouts anywhere else? This was the same situation the lady I went with had. No idea of the outcome yet, but it wasn't half as bad as she expected.

 

 

Does he work? If so where is his wage slips sent? Same thing if he is on any benefits. If it is only the bank registered, then that is easy enough to explain.

other things you may want to consider is have either of you applied for credit as a couple, or has he applied for credit using your address, does he pay any of your utilities or household bills, has he been paying rent, council tax or utilities at a different address

He has not changed his bank details, which I keep asking him too but he did give the council tax dept his new address when he first moved out, as they sent bills there in his name. Not sure about credit file, but he does have a credit card still linked to this address. If he has applied for credit elsewhere I don't know but bet he did use this address if so.

How can they prove he lives here when they have not even come to the house to check? If they did they would see he patently doesn't live here. I am not in control of his actions or non-actions, as in not changing address. I can only keep asking him which I have a million times. This seems so unfair..

 

I have got him to write a statement saying he is no longer living here, has not since May and the reasons why he has not changed his address details. I can also get a written statement from the friends he sayed with after he left his Mum & Dad's house, and from the people he now lives with. Would this help?

Remember it's up to THEM to show he DOES live there?

Doesn't sound like they have enough to go on to prosecute you by the way.

It's likely that they have been sat outside watching & not seen him stopping apart from every other weekend & just have the bank thing at the moment. Or they may not have got as far as sitting outside watching.

Every other weekend is not excessive. I used to let the kids dad stay at mine every other weekend when I was on income support years ago, & I would stop at a friends after we had been out on the town.

Me & their dad also had a joint bank account that wasn't closed down until last summer! We split 10 years ago lol

Honestly, if this is all they have to go on so far, they will have a hard job taking you to court.

When you go for the interview, make sure you dont panic & say something that isn't fact.

That's what the interviews are for, extra evidence to use in court. Dont give them it.

Just make sure he removes any connection to your home now. x

Apparently it isn't that common for them to sit watching people. You will have people coming and going at all times. Unless they are there constantly to see who is coming and going, it is circumstantial.

 

Make sure you have ANY proof of him living else where during this time. And take any paperwork with you. Stay calm, and tell the truth. If you split up 10 months ago, then they can't really have much against you. It seems a lot of these interviews are more for people to give their side of the situation, rather than stacks of evidence against them.

 

If you want to get advice from a solicitor, try and get one who specialises in welfare. They are allowed to get the information from the investigators before you go in to the interview, so you can see what evidence they have.
