      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all,

Letter today from Fred Int saying "you have failed to make an acceptable payment arrangement. Don't ignore this letter!" with a payment card listing my 2 nearest post offices.

 

I can't get my CRA file at the moment. But will soon hopefully.

 

 

FI also sent a second letter with an income and expenditure form that I "must complete and return within 7 days!"

 

Wow, I just looked at the form. They want Bank, Branch, sort code, account number, employer, pay day weekly or monthly, plus the usual.

 

Also "Please confirm that you have discussed the use of assets to make lump sum payments".

 

Cheeky beggars.

Hi all,

 

Wrote to Tesco with and offer of payment and a cheque for the first monthly payment (which they cashed) and asked how I can pay by standing order.

 

I have now received a letter from Bryan Carter demanding repayment in full or ring Fred - or litigation!

 

Should I write to Fred and tell them I am paying Tesco?

Hi all,

Fred Int has written: despite a recent letter from Bryan Carter you have failed to discharge your debt... before we recommend legal action to our client... as a gesture of goodwill we are prepared to accept a full and final settlement on this account - if you ring within 48 hours...

 

What a nice gesture of goodwill.

 

We are paying Tesxo each month but they haven't replied to my letter requesting details for a standing order yet.

Hi all,

 

Have been paying £4 per month to Texsco and FI have now written to say that they will accept £4 per month, pay direct to them by s.o.

 

"Payment MUST be made by the due date, threat, threat etc."

 

I would rather pay Texsco directly.

 

What do you think? Don't want to go to court, things are already bad on the home front this year.

scan the required letters/agreements/sheets

as a picture[jpg] file

remove all pers info inc barcodes etc using paint program

but leave all figures and dates.

 

goto one of the many free online pdf converter websites

it would be better to upload a multipage pdf

than many single ones

or if you have PDF as an installed printer drive use that

or use word and save as pdf

open a new msg box here

hit go advanced below the msg box

hit manage attachments below that box

hit the add files button on the top right

hit select files, navigate to your file on your pc

hit upload files

NB:you can set where it goes in the post by hitting insert inline.

I haven't moved so that raises some other questions:

 

Have they given up on collection even though I send a cheque each month with a letter from my address?

 

Has FI told them I can't be found to get themselves off the hook?

 

If I SAR them will that confirm my address and open up the can of worms again?

 

This account has been handled strangely as you can see from my earlier posts.

 

Not sure what to do next.

Hi All,

It's been a while but I am still kicking. This one has raised a problem again.

 

I kept to the agreement for this debt, paying Tesco £4 per month by standing order, which we can afford, although my circumstances are still poor.

FredInt are writing again, demanding we pay them.

 

Tried Fredpay but it didn't work, anyway I don't want to pay FredInt.

I wrote stating we have an agreement and are paying oc direct.

 

They replied:

"We are instructed by Tesco Bank to collect the above."

"pay us, or else"

 

Not sure what to do.

1) get credit reference (it's a bit of a nightmare process, or is it me)

2) request CCA again and see what they come up with,

3) complain to Tesco.

4) SAR Tesco or FredInt?

 

I have had a lot of successes with Cagger's advice, with CCA's being unenforceable, and I thought that this loan arrangement was working.

The return of the stress and upset is making me angry.
