They do not have to provide this information in respect of a Subject access request as the items requested are covered under the CCA1974.

 

You will need to ask for them via a CCA (s78) request.

 

It will cost you £1.00 and you should also ask for a statement of account for each agreement. They have 12 +2 working days to respond.

BC confirmed they do not have this information and unable to supply under any request and say contact DCA

 

The account was passed to a DCA via a group sale agreement in 06, I have done a CCA (s78) request to the DCA early 08/11, and still have not replied to request.

 

They have included a set of TCs in a court bundle, because I am unable to obtain copy from OC, I need the requested info to compare the TCs and identify if they are vaild for 04 or 05 onwards.

If the information required is prior to the assignment to the Debt purchaser then Barclaycard is responsible for supplying the T&Cs.. I will try and find someone who can advise further.

My understanding is that the original creditor will ALWAYS have a responsibility to provide a customer with information that relates to their account irrespective of whether it has been assigned or not. Barclays of course will say this. There are 2 options open to you 1.Ask them for a final response in writing stating that you will be making a complaint to the FOS 2.Ask them for a final response and put them on notice that you will file for a Court order to force their disclosure and will apply for costs. I took the latter route with Barclays myself and the Court ordered them to supply them to me or else provide a signed witness statement to the Court indicating that a full search had been done and that they had not been able to locate them. Barclays has the largest archive of banking documents in the world so it would be very difficult for them to say they do not hold these.

Yes, I received the fee back, if I recall 250/260isn but no other costs. I was expecting them to restart claim, as you said spec invoice and I had a solid defense, if they did.

 

ps, here is good one for you, many years ago cag help me win against HFO, which lead to oft,fca who contact me directly about my case. I then contact Barclycard for refund of all charges, they agreed but rather than paying me the £890.00, they gave to HFO

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...
