what does this mean if we already have a claim in process with welcome and they're already investigating?

would this still be passed on or would welcome settle it themselves if it's already under investigation?

I understand that due to Welcome's default status they can set-off any PPIlink3.gif refund against any outstanding loan balance - just so you're aware.

where did you get that info

any refund can be used to offset any arrears, thats all

I spoke with someone from Welcome Finance's complaints department this morning and they advised that if you have a ppi complaint that they had already been processing then they would take priority at the FSCS. If you have already accepted an offer from Welcome before today's date then they will be honored (or so say!!!). If you go through to the FSCS helpline for Welcome customers, you actually get redirected to Welcome Finance........ interesting!?!

Will the ppi refunds be paid out in full or will they only pay out a fraction because the FSCS are involved. Is it welcome that will be paying the refunds or the FSCS ?

Are welcome at risk of loosing their licence now that they are in default ?

What about the issue's with ppi that is in with the monthly loan repayments, will the FSCS do anything about that....

Couldn't have happened to a nicer bunch

Does anyone know if this new status will affect other claims against them for other equally abhorrent behaviour?

I got the FSCS letter yesterday. I am rather bemused by it as my case has been with the FSO for 2 years & my last communication to them was to query why i should sign a new agreement BEFORE Welocme would tell me any figures in relation to a rebate, the FSP never mentioned compensation either! As I have not paid them anything for 2 years if I were to get any compensation it would not be paid to me, only deducted from amount owing. Now that is going to be interesting as Welcome have sent me 3 different 'New' Agreements with different amounts on each! Never have the agreements showed amount already paid. I wonder how they are going to figure that one out???

We are in exactly the same situation as this. Do we fill in these forms and send them back? They require signatures and such, and if I understand it, the **** will be dealing with the returned forms!!!

I don`t understand what happens to all the other complaints already with FOS when this form is filled in and signed, the FSCS are given all future legal rights with the account, they then as stated in the forms "Stand in Your Shoes"!!! What does that mean?

I am also confused as to wether the paperwork we received is from FSCS asking for further info from us after receiving stuff from the Ombudsman, which will enable them to assess the claim. Or is it from the ****, trying to get us to sign and force everything to start from the very beginning again? Pulling the wool over everyones eyes in the process.

Lots of phone calls in the morrow me thinks. I may be over complicating things for us but this is the **** *ucks we are dealing with.

Cheers Mark

ive decided to hang fire signing and sending anything....it all stinks imho....like mark we too have fos involved..so waiting to see what appears in the near future... plus we havent paid anything to them for the last 2 years..so any refund due will just be snatched back, theyve already defaulted us on cra...so whats another few years?? especially when they have the audacity to regurgitate and reinvent a so called agreement ....as far as we are concerned they can wait to get their £24.5k ...not!!!!

let us know what you unearth from your phonecalls mark..

Just thought this bit of information may be of interest. Any claim put through the FSCS for refund of PPI's on current loans will be paid off the outstanding balance of the loan whether there are any arrears or not!! Seems to me that it is a devious way of keeping Welscum finance in business!

nope they cant do that.

what will happen is any PPI you have actually PAID can be used as off set against NOTIFIED ARREARS ONLY.

the PPI you have YET to pay - will be removed from the outstanding balance [as you've not actually paid it!]
