Car accident, I wasn't liable, my claim still in progress for ONE YEAR!!!?

Hi everyone!!

 

I had a car accident in February last year. I was approaching a bridge while other car hit my front right wheel and side. He was driving in the middle of the road and when he saw me he tried to turn to the side. I landed past the bridge still on my side of the road. The other guy landed in the middle of the bridge obstructing the road. He didn't want to call the police etc.. he just called AA and towed his car as quickly as he could. I called the police and got an accident report, took some pictures and got the other guys details. As I was insured only 3rd party and there were no injuries my insurance company and other 'no win no fee' guys don't want to help.

 

I've got the official report from my insurer saying that they believe I wasn't liable at all. They tried to contact the other parties insurance but they are not responding! I've tried to write letters to them asking to proceed with the claim and to start doing something. They are not responding to me as well.

 

I took advice from my local citizens advice bureau and they basically asked me to wait. My insurance says I should take my own solicitor but it would cost me around 145£ an hour and there would be no warranty I will get any money back.

 

In result I lost my car which I was using to get to work. I had no courtesy car. I lost around 1000£ by keeping my car in a garage who charged a daily rate.

 

I feel like there needs to be something more I can do I just have no idea what...........

 

Has any of you guys had a similar problem??

I called the police and got the accident report slip (or however its called) but the other guy was already gone and his car towed by AA.

 

I also took pictures with my camera, got the guys registration plate and all his details including the details of his insurance.

Work out you losses and the write directly to the TP asking him to send you payment to cover the full amount within 14 days or you will commence court proceedings without further notice. Add that he may wish to pass your letter on to his insurers who will perhaps settle on his behalf.

Hi

This info will help. If you share some info I request it will help me in your best methods to go about it.

Firstly you say you had an accident, the AA should have done some kind of report when they pickup up the other persons car. Also your pics will help with the senario.

 

In accidents you are to mitigate your loss so if your car is in a garage and incuring storage you will have to remove that asap. make sure your car is not sold or destroyed untill after a independant engineer has had a look at it.

(personally I would pay £60 for a independant engineer to have a look at it, you need to notify the third party about the engineer you are going to use, min 7 days).

How much is your car repairs worth? If your repairs are less then £5000 then you can issue a claim in the county court and if you loose you pay only £80 to other side +court costs, make sure its small claims and NOT fast track.

You will need advise but a Solicitor is not worth it if your repairs are less then £5k.

 

What you are intitled to

Cash in loo of repairs (repair costs)

Cash in loo of hire- as you never hired a car.

and maybe interest depending on judges discretion.

Some rent and storage- you need to inform the third party of what you are doing (never talk to them as you will regret it, best to write a letter recorded delivery).

loss of earnings if you missed any days as a result of the accident.

anything else that may be related to the accident.
