Hi i received a ticket for 'parking in a restricted street during prescribed hours'. I challenged it as as I understood it was because I had parked in a street covered by permits, problem being there were no signs to the entry of the street to which I entered to indicate this. Therefore the signs governing this restriction are not visible, either from the area where I parked the car or upon entry to the road and provided visual evidence as attached to support this challenge.

 

However received a response from the council saying 'the vehichle was parked in contravention of the waiting restrictions in force. the restrictions were clearly shown in accordance with the Road Taffic legislation. Unless you can provide proof, for example a delivery note or order, your reasons for parking there are not acceptable as grounds for cancellation of the PCN, Your vehichle was parking in contravention of the waiting restrictions in force as indicated by double yellow lines. Waiting restrictions indication by yellow lines apply to the carraigeway, pavement & verge'

 

My contention therefore is that they have issued the ticket incorrectly as now trying to get me for the yellow lines rather than the restricted area; or does the PCN reason cover DYL's as well? Your advice would be appreciated.

Thanks Green_and_mean, so are you saying I have no grounds for challenge as restricted street during prescribed hours covers double yellow lines as well?

 

I wasn't there so haven't a clue if you have grounds for appeal, but you are confsing yourself by thinking a restricted street does not mean parked on yellow lines which doesn't help.

Yes sorry - I found out that after I got the ticket that the road is permit only, although this is only indicated at one end of the street. I parked at the bottom end where there are double yellow lines although and I parked on the waste land off the road, shown in one of the pictures.

 

I thought the restricted street during prescribed hours was getting me for not having a permit and not sure if this extended to the double yellow lines. If it didnt then I thought I could contest that the council had issued incorrectly. However got a feeling it covers DYL's as well :-(
