    • Ok you are in the clear. The PCN does not comply with the Protection of Freedoms Act 2012 Schedule 4 for two reasons. The first is that in Section 9 [2][e]  says the PCN must "state that the creditor does not know both the name of the driver and a current address for service for the driver and invite the keeper— (i)to pay the unpaid parking charges ". It does not say that even though it continues correctly with blurb about the driver. The other fault is that there is no parking period mentioned. Their ANPR cameras do show your arrival and departure times but as that at the very least includes driving from the entrance to the parking space then later leaving the parking space and driving to the exit. It also doesn't allow for finding a parking spot: manoeuvering into it avoiding parking on the lines: possibly having to stop to allow pedestrians/other cars to pass in front of you; returning the trolley after finishing shopping; loading children disabled people in and out of the car, etc etc.  All of that could easily add five, ten or even 15 minutes to your time which the ANPR cameras cannot take into account. So even if it was only two hours free time you could  still have been within the  time since there is a MINIMUM of 15 minutes Grace period when you leave the car park. However as they cannot even manage to get their PCN to comply with the Act you as keeper cannot be pursued. Only the driver is now liable and they do not know who was driving as you have not appealed and perhaps unwittingly given away who was driving. So you do not owe them a penny. No need to appeal. Let them waste their money pursuing you . 
    • If Labour are elected I hope they go after everyone who made huge amounts of money out of this, by loading the company with debt. The sad thing is that some pension schemes, including the universities one, USS, will lose money along with customers.
    • What's the reason for not wanting a smart meter? Personally I'm saving a pile on a tariff only available with one. Today electricity is 17.17p/kWh. If the meter is truly past its certification date the supplier is obliged to replace it. If you refuse to allow this then eventually they'll get warrant and do so by force. Certified life varies between models and generations, some only 10 or 15 years, some older types as long as 40 years or maybe even more. Your meter should have its certified start date marked somewhere so if you doubt the supplier you can look up the certified life and cross check.
    • No I'm not. Even if I was then comments on this forum wouldn't constitute legal advice in the formal sense. Now you've engaged a lawyer directly can I just make couple of final suggestions? Firstly make sure he is fully aware of the facts. And don't mix and match by taking his advice on one aspect while ploughing your own furrow on others.  Let us know how you get on now you have a solicitor acting for you.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

As some of you know these 2 companies have been harassing me something shocking.

 

GB Consumer finance/Mason Chase ltd, run a number of websites such as purplepayday/paydaypush/urgentcashtilpayday/cashline/247cash and more

 

Anyway i recieve anywhere from 5-17 textes a day, i have replied several times to stop, but to no avail. On none of the websites is there a telephone number, mostly just an email address which in most cases come back as undeliverable.

 

I have complained to ICO - who have upheld my complaint, and have written to GB Consumer finance reminding them of the obligations.

I have also now complained to Advertising Standards Authority (Mason Chase has been warned already - google mason chason 2nd link down) they failed to respond to the ASA so they upheld the complaint.

 

ICO advised i should allow 28days, and if they comply i should no longer be harrassed.

 

If im still recieving these texts do i have grounds for a court case against GB CF?????

 

 

Easy-loans again no numbers on their websites.... hounding me with texts, even claim on one of their websites loans in 15mins, but WOnga aint an affiliate so thats a big white lie!!!

 

 

Any help from the legal eagles would be great...

ps.. all texts im recieving from these 2 companies im keeping as proof. Vodafone say they can supply me with dates and times when i

sent the stop messages, if need be

Have you considered contacting your mobile operator and seeing what help can they offer?? Is it coming from a set number??

 

Edit saw your vodafone ref ask if they can do more??

thats the problem they send of different mobile numbers.

 

i reckon even if i did take them to court, they wont turn up, and probably fail to pay whatever the court fines them!!! boy o boy then id hire a baliff to go to their offices!!! id have to drive the whole way from scotland down to chester and invite all caggers round to the car park to watch it unfold!!!!

So just whisked my complaint off to ASA... lastest tet i got was 100%approval rate!! This company isnt even a lender!!

Latest website these guys are using in lastmin3.co.uk

No mobile numbers on show, and unable to reply. now states to send text to 81101, but guess what.. delivery report says pending!!!Im gonna have a field day with this bunch if/when i go to court.

Another quick update...

 

So the ASA has been informed and now i have informed trading standards...

The latest test from National cashline again say 100%approval..... then it says reply stop to stop messages, however as a mobile number no longer appears, there is no reply function for the message!!

 

I replied stop to a message last week, and got a reply advising i would be removed within 24hrs...

Recieved nothing yesterday, but lo and behold i got one today..

 

Thank you boys....

Ok so another wee update....

 

Trading Standards South Lanarkshire/Chester are now dealing with this.

ASA are now in possesion of the 'misleading' text.

 

I assume il hear back from ASA in the next 4-6 weeks, as they will attempt to correspond with GBCF, but i suspect they wont get an answer!!

 

Il update when the ASA make their ruling!!

Which i can only expect the compaint to be upheld.

I get harrassed with these texts ALL day they wreck my head I am forever replying stop but it just doesnt do anything, sometimes I even get not able to send to them !!!

 

Ok start keeping the message you recieve if you reply stop turn on delivery reports and keep this (its proof you asked to stop)

 

Now contact the Information commissioner - www.ico.org.uk

Also contact consumer direct, who will take details and pass to your local trading standards

And if any of your messages state 100%approval complain to the Advertising Standards Agency as this company is NOT A LENDER - therfore cannot guarantee the lender will lend. www.asa.org.uk

 

The ICO has found in my favour

Trading Standards are unhappy that some messages i cant reply stop even though it says!

ASA - this will be upheld!

 

I still get maybe 1 a week, but better the 4 and upwards a day!

 

If they dont stop once all 3 rule in my favour il threaten court action, and i will be able to show the courts i have tried all reasonable attempts to have these messages stopped, and the company in question wont, also that 3 bodies have ruled in my favour, but that the company doesnt listen to them either.

 

ASA has already ruled last october in favour of a complainant against MASON Chase/GBCF.

I've had a spate of the 100% approval at mad rates.... and one great text which stated "MAD approval rates for loans". Ignoring them seemed to work, or sending back "This phone is in the hands of the UK anti fraud authorities, you will be contacted shortly regarding your association with our suspect.!"

 

Cash Genie still don't get the message though that I do not want a loan from them... have sent some shirty emails back, now going to go down the ICO route with them.

Another update on these clowns.....

 

Am callin trading standards for an update tomorrow.

Had a message on my phone from the ASA asking me to call tomorrow, as they are having trouble getting a response from GB Consumer Finance/Easyloans/ are as they are now called PINGTREE ltd....

Suspeected as much anyhow....

Ok so Trading standards still investigating....

The Asa spoke to me today..... interesting, but not surprising!!!

They hav noted a number of websites connected to this company. Firstly the correspond by email, by EVERY email address they use comes back as undeliverable!!

So they said it would take a bit longer than usual.

We have the ability to permanently remove you from all lists and all messages give you the option to reply with a STOP message which is free. This also ceases all messages.

 

If you send me your mobile number, I'll make sure it is permamently removed and if you send me your address we'll pop a small gift in the post as an apology.

little update people:

 

I done a bit of research on Mark Kennedy, and i came up with contact details.... I duly made contact, and Mark called me back, which i have to thank him, as there is many that wouldn't bother.

 

His post is on the back of a lender notifying him about this thread... so thank you lender, whoever you are, as i feel this may be finally resolved.

 

I put my concerns to him, and he is going to look into this. I asked why when i send stop, do i continue to recieve messages, and why so many texts a day. He is unhappy as its a cost to him to send a message.... He advised at most they do 2 text runs a day, so i shouldnt have recieved more than 2 in one day.

I also asked why im recieving 100% approval texts when he aint a lender. He advised depending on the data he has on me, based on that information and the criteria of one of the lenders he passes the details on, i would get a loan, though a bank statement may be required.

 

People whose information differs would not receieve the same text.

 

I also noted to him that th email addresses on his websites dont work, again he is going to look into this, as i also Advised him the ASA are having trouble making contact.

 

Hopefully Mark will act on this, and my situation will be resolved. Everyone deserves that chance, and Im giving Mark that chance to rectify my situation.

surprise surprise... thex text messages have started again.... 1 yesterday, 2 today from lastminutepayday.co.uk which is run by mark kennedy...

 

Will be emailling them in the morning, and i might need to escalate this. Ive got the emails from the regulatory bodies to confirm ive done everything reasonable, and email from adma brogen and mark kennedy advising i would be permenantly removed, but it seems their system in incapable of permanently of removing my number.

I've just received 40 FREE TXT MESSAGES from easyloan-ltd and counting. ****ing unbelievable! I'm so ****ED OFF what's the ****ing point in doin that? If there trying to gain extra customer there certainly going about it in the wrong way.

 

IF ANY BODY FINDS OUT THERE TELEPHONE NUMBER! PLEASE POST IT IN THIS FORUM SO PEOPLE CAN GIVE THEM THE **** THEY DESERVE!!!!!!!

 

I'm going to try my hardest to find there number and SHOUT AT THOSE ****ERS. They'll remove your number if we all shout at them and complain to the correct officials.

 

AGAIN! PLEASE FIND easyloans-ltd telephone number and post it in this forum and as many forums as you can find! The only thing we can do is HARASS THEM BACK!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

Pingtree run a payday loan affiliate scheme basically, you'll see their application on loads of different websites, most of whom will give you the impression that they are a lender when in fact, your application once submitted enters the 'Pingtree' At the top of the tree is the company that offers the most commission, Mr Lender for example offer up to £50 for a successful referral, so they may get first dibs at your information, they'll process it and if successful all well and good, if not then your information drops to the second highest (PDUK pay around £45 per referral so it may go to them next) - this goes all the way to the bottom when you'll end up with someone like easy loans or another brokering service - or WDA who seems to accept even dead people. The pingtree would have anything up to 25 lenders in it, all at different levels, so christ knows how many credit searches you'll have done in 1 application.What's also misleading is that some of these websites show a CCA Licence number, fooling you into thinking they are a lender when in fact if you look at their licence, you'll see they are only licensed for credit brokering not lending.They harvest your personal information and store it, then it's resold for pence to marketing spammers who send you all of the messages.I really hope that you get somewhere with this, it's about time this industry was regulated properly
