      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi All,I am new to the forum and looking for some help regarding welcome finance.

 

I have been asking them for a copy of my file for about a year now and have just ignored me every time (must have done it 3/4 times)

 

Their solicitors Howard Cohen also ignore my letters.

 

I am trying to get a copy of my file and everything they have regarding my car finance.

 

I am going to write to them both 1 last time but if they ignore me what is my next step?

 

I am also trying to get a copy of the ccj they have against me ,

 

i have called the court it was issued in and they said it has been moved to Keighley court and cant send me a copy,

 

i spoke to Keighley court and they told me to ask the solicitors.

 

Does anyone know how i can now get this information

I got the car in 2006 and it was faulty and the engine was in a bad condition,

 

i complained to welcome and told them to take the car back and cancel the credit agreement.

 

They came and took the car like i requested and they told me paperwork would follow.

It didn't so i chased them many times, which I had no replies.

 

I then find a ccj on my credit rating dating from 2007 from Welcome.

 

I received no paperwork regarding this before 2009.

 

I have written to them many times asking for a copy of my file

 

, they sign for it and ignore it and so do their solicitors

Hi.log onto ICO and make a formal complaint, regarding Welcome and the Courts total lack of help,

 

then send a formal complaint to Welcome(check online for their Welcome complaints procedure) at the same time

 

send Welcome a SAR and state you require all data including their copy of the CCJ .

 

Tell Welcome they have 40 days to respond and letters from H Cohen will be included in the court action should they choose to ignore your SAR

 

(got to say omit the court action part unless you are prepared to proceed with this)

 

this approach will slow them down and should achieve results

I have been having an ongoing battle with welcome finance which I have posted in the Welcome section.

 

However Welcomes solicitors - Howard Cohen keep calling me and threatening to get a charge on my house as I refuse to pay the ccj

 

they have against me.

 

Now the ccj/account is in dispute for many reasons.

 

How will I know if they are really going to get the charging order ,

 

will i receive some paperwork?

, the solicitors recently called me to say they were getting a charging order on my house,

 

they haven't sent this in writing.

 

How do I find out if they are actually doing this,

 

will i get some paperwork from the court/sols etc?

Hi marshma

 

I believe the Court will send you court papers and you will have the opportunity to defend within a set time scale, it might be an idea to do a bit of reseach on 'Charging Orders' so your ready to defend, if and when the papers arrive.

Firstly they will get an interim charging order, which you will not know about, they will then apply for a final charging order where you can attend the hearing and have the opportunity to oppose.

Something to look into, if the property is is joint names, but the debt was not, I beleive they can only get a restriction as opposed to a full charging order.

If you have a judgement, take this seriously as it's not wel****,

but the law should the the claiment wish to go for Enforcement.

 

Your details are sparce, so post up the full amount,

 

when the ccj was registered.

 

Who owns the house.

 

Is the debt in Joint names.

 

Is the house in joint names.

 

IMO it's best not to speak verbally on this matter.

 

A interim c/o will be sent to you by the court,

 

I would seek further advice, from cab, ndl, ccc etc.

 

If you have a judgement,that's what it is,you can only dispute it through the courts.

The ccj was done in 2007,

 

i have posted about this in the welcome section if you would like to have a look.

 

I knew nothing about this until I got my credit report.

 

The amount is £15,293.

 

I then get a letter from their solicitors Howard & Cohen telling me they want details of my income etc,

 

i wrote to them telling them I was doing no such thing due to me waiting for Welcome to get back to me ,

 

i have asked them many times for a copy of all information yet they have been ignoring me.

 

I have used the SAR template and will send it recorded tomorrow.

 

I have asked the solicitors to hold off their action until their clients respond to me

and they do for a while but then try to call me and threaten me with a charging order etc

 

The ccj is for a car i bought but returned because it was seriously faulty, the house is in my name only :(

I didn't defend it because I never received any paperwork and had no idea Welcome were doing this.

 

I only knew about it because i got my credit reports regarding an ongoing dispute

 

I had with essex & suffolk water and wanted to see the damage that had done to my credit rating

I had a previous car with welcome and then decided to get a new one through them again

as i got near to the end of the payments and needed a bigger car, the old one was at my old address,

 

I then moved and decided to get the new car but i was living at my new/current address.
