    • I've been on this site for eight years and I haven't seen one PPC case where a DCA turned up at the motorist's door. Even if they did they couldn't do anything, but in any case it's never happened.     • thanks I’ve not used this website before haha is the DCA the furthest they’d take this case? didn’t know if there’s a step up as they are affiliated with the FA. im clueless with this sorts of stuff so as expected it concerns me and would your simple advice be to simply ignore even though we’ve had a physical lettter through from soccersixes themselves 
    • a DCA is NOT A BAILIFF and have  ZERO legal powers on ANY debt - no matter what it's type. moved to the gyms/Health clubs forum. not sure where you get the idea that any ole debt passed to a DCA gives them some magically power to make it appear on credit files..

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all, I am stuck. I have been registered as a member for a while but not really used the site before.

 

I sent an SAR request and have received a response which I have attached.

 

Can anyone tell me if I am being fobbed off here as surely companies have to hold details of who called who and when regarding the account its not my job to do that and as they are also usually recorded surely there is notes on the account to say so also.

 

Any help is appreciated as this is in relation also to a court case.

They are within the scope to ask that your requests are specific.

Do you know the dates ?

You could ask for telephone call logs and get the info from there-though they could do this also.

Who did you make the SAR to?

The request was sent to GE Money.

 

Surely as you say they would log each call and would then keep a record of calls made so I could ask them for that but then they may still fob me off.

 

Do you know if they have to keep a log of calls made either to me or from me?

I have done a number of SARs from banks to The Council,from Insurance Companies to Telephone Co's

I always ask for telephone logs,you will know as most do,its hard to speak with any organisation these days,without being prompted with a message that calls are being recorded for training purposes.

Sometimes a data controller will use what is called disproportionate effort to avoid compliance.

They are entitled to use this if it can be seen that there will be much work involved in meeting your request.

If they do cite this then they have to say why,and also indicate if a further fee is required and how much.

They can also use non specific requests as a reason to deny full disclosure.

If you are not exactly sure of the date and time,you can say on dates between XXX and XXX made from xxxx tellephone number to xxxx (their number)

Maybe you can find this info on your own telephone bills.

So ask for a log and screenshots-screenshots of account activity can often reveal content of calls.

Thank you for your help.

 

I will try asking for the call logs and see where I get.

 

They maybe don't want to give me them as I had to send them a letter a while back regarding harrassment telephone calls so that is why they maybe do not want to disclose this information.

 

Kind Regards for helping. I will ask again if I come a cropper further down the line.

give them an ultimatum,i.e. tell them they have 10 days to comply with your request,if they cannot then" their failure to provide all of the required documentation within 10 days from receiving this communication constitutes your agreement to the following terms,1,the debt did not exist.2,it has been paid.3,any contract was voidable from the start.4,you accept liability for any damages i suffer as a result of your actions.5,you abandon this claim and will pursue this matter no further .I presume silence to mean acquiescence in all these matters.

gearjamma,the poster has not yet given details of why the SAR is being requested,I think therefore its a little presumtious to offer such advice without the further info.

Newto,for the record,a data controller can refuse a request in part on the grounds of non specific request,as prev advised.

The other reason can be under whats called disproportionate effort,this is where they can say that to comply needs more work and time to comply.

Where this is used,they should indicate the reason and give the additional amount payable for them to comply as was pointed out.

Welcome to The Consumer Action Group.

 

 

I am just letting you know that as you haven't had any replies to your post yet, it might be better if you post your message again in an appropriate sub-forum. You will get lots of help there.

 

Also take some time to read around the forum and get used to the layout. It is a big forum and takes a lot of getting used to.

 

 

Once you start to find your way, you will soon realise that it is fairly easy to get round and to get the help you need.

 

It can be bit confusing at first.
