      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Can anyone advise please.

 

We have just had our house reposessed by Ascendum/Capstone/SPML/COWBOYS - just last month (Its now up for sale at a ridiculously low price).

 

Too cut a long story short the mo. co was chasing me for 3 months arrears. We were going through a bad patch with work etc (oh and the csa)!. We had got into arrears last year with the mortgage and that was paid up then we got into arrears again. They were threatening eviction etc and when we made phone callslink3.gif to try to make an offer we were told (FULL PAYMENT TO CLEAR ARREARS ONLY!).

 

Anyway we moved out and rented a property as we were sick of the bullying tactics and that of the csa also(who were also trying to force a sale via charging order on the property).

 

We have just read about all the charges people have been charged and realise that we have been charged all of the same and in fact if we hadnt we probably wouldnt have been in the situation(TOO LATE NOW WE REALISE!!).

 

Is it too late to claim any charges or fees???

 

The outstanding mortgage was £116000 house is up for sale with an agent for £135K. The csa have a charging order for £20k - (long story).

 

Also house in sole name - partner of 9 years not on it. 2 small children also.

 

If we could recoup some monies it would be a great help as because of the situation we are finding it hard to make ends meet. Also wether right or wrong as we have moved we have had no contact with the mortgage company since and hence they dont know were we live (and csa also)

Also on the date of the eviction ascendum contacted us by phone call. The time of eviction was at 11am and they called at 9.58am to say that if a payment was made the eviction could be stoppped. Obviously by this time we had made arrangements for somewere else to live and scraped and borrowed for the months rent and months deposit so this was not an option. We explained to the mo. co represenattive that if we had been offered this help months ago we would have taken it and that he was the 1st person to have listened to our circumstances. We couldnt afford it so we just went at 11 am and handed our keys to the lady sat outside our old house. Gutted isnt the word. The amount of arguments in our house that were caused by the noose put around our necks by ascendum or whatever they call themselves was unbelievable. Thankfully home life is a little better without the noose but still its not our own home. Thanks to these cowboys who change there name more than anything - I would strongly urge any new prospective homeowners STAY AWAY from this company at all costs.

bathspray if only you had come here earlier and could have contested the eviction you saw what was taking place on daves thread.Maybe as the house is for sale in a poor market its not too late to have the court order rescinded.

You are very isolated here suggest you post up your situation on the main spml thread here and ask fo ellenns help to see if theres a way back and yes you can claim back the charges.Post up your whole story such as was your house under a suspended repo order and what were the full arrears they stated you owed and the true arrears ie missed payments.
