    • Yes, await the Directions Questionnaire from the court. No, the Directions Questionnaire is just a short form and leads to the case being transferred from MCOL/CCBC to your local court.  If you Google "Form N180" you can see a blank copy on government web pages.
    • There will only be one hearing (typo possibly 25th is a Saturday Courts closed ) clarify with the court.

    • No Andy, I'll scan, redact and upload later today. So the court sent me 2 letters, same envelope and stapled together but with different dates!. 1. N24 General Form of Judgement or Order, stating: UPON considering the papers herein IT IS ORDERED THAT The claim is listed for an attended hearing 25 May....... at which court will consider allocation..  etc   2. N24 Notice of PTR/Adjnd/Restored/Hrg/Management conference TAKE NOTICE that the hearing will take place on 24 May at....... When you should attend 30 minutes has been allowed for the Hearing   No other instructions anywhere in the envelope or on the letters. Do I attend both?
    • Then leave it just proceed with the claim( strike out/SJ application are risky).....the defendant will not be permitted to rely on written evidence (documented) only verbally as they failed to comply with the N157 (unless they have filed with the court and failed to serve you a copy) ?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Can anybody tell me if you can claim back PPI charges on a Mortgage?

My husband and i took out a Mortgage in 1996 and were bamboozeled into taking out a PPI without knowing what we were signing up to. We were told we had to have it with the mortgage.

We have never claimed anything from it but paid a fortune into it. We no longer have this Mortgage.

Any info would be appreciated.

Thanks I did not know for sure.

All the press coverage seemed to focus on loans and not motrgages.

I have read the tread you directed me too and we were told that if we did not take out their PPi we could not have the mortgage so we were pressed in to it.To be honest it was not explained properly either.

Mortgage PPI is hard to get back, the mortgage process is mostly advised, the adviser had to do a fact find (a full assesment of his finances and needs) so would be asked questions about his employment benefits, pre-existing medical conditions etc. A lot of mortgage ppi is monthly paid too, which is good as single premiums is bad, as it incurs interest.

 

Unfortunetley you would have no proof that you were pressed into it, its your word against theres, and they have the evidence that you signed for it and issued you documentation.

As already has been suggested go forth and submit your claim for mis-sold. If it was not explained to you exactly what the ppi was for and what the benefits and exclusions were, or that you could get a cheaper policy elsewhere then it was mis-sold and despite what your mortgage provider may well tell you it is not statute barred.

 

Personally, I would write a letter to them outlining why you believe the policy was mis-sold and requesting a refund of all premiums paid plus interest.

 

Is also a good idea to do some calculations to send in with the letter to show you know how much you are entitled to. If you need any help with these just ask.

 

As for the comments in the previous post, what a load of rubbish. The onus is on the provider to prove that everything was done correctly rather than the borrower to prove it was not.

Thanks everybody for your advice. However conflicting it may be.

It just goes to show what a grey area this is.

Do you or anybody else know of anybody who has successfully obtained a refund for mis-sold mortage PPI?

I am no way going to let this one go but it seems that on mis-sold credit card and loan PPI is being refunded.

I hope somebody can tell me different.

You are right that the onus is on the firm to prove it was sold correctly, however, don't dismiss what I said was rubbish. I talk facts.

 

my point was is that the mortgage process is far more in depth than the sale of a loan (ppi is just whacked on) or credit card (box is just ticked) with ppi. Mortgage advisers, not so much in 96 do a full fact find, far more documents are issued. Its a different sales process.

 

I would point out that the complaint point you were not told you could get it cheaper elsewhere. This is a mythical complaint point. A firm is not obliged to discuss and advise on products it does not sell, is the truth.

 

I know this as I worked as and adjudicator at FOS until recently.

 

More firms are time barring now as the guidance on ppi complaints changed and firms are arguing they should not have to apply icob rules retrospectively, the rules with this is if they don't complain within 6 years of the sale, or 3 years since they knew there was cause to complain, whichevers the longest.

To help, who sold it to you? how was it sold? (phone, face to face) and was it paid for monthly (good) or single premium (bad)?
