hi surreylad - my typos are terrible! what I mean is that there were additional charges added to the paperwork after I signed, I have asked for copies of the paperwork now but nothing has turned up yet? I was charged an arrangement fee and some kind of insurance that protects them not me because it was secured on my home. (if my memory serves me well) I do need to investigate this matter in order to understand what the charges were and for what, starting with the documents when I get them. even if they turn up the original agreement I will be querying the loan arrangement fees and the insurances around 1K each.

Yes they are.

 

My car finance is in joint names, and whenever they send out a letter they send one to me and a seperate one to OH!!!!! I phoned them up the other week and they said it was due to data protection act (I know I know), anyway gave them a right ear bash they said they are only charging me for one letter, so I said if that the case how come one letter costs £10 and the other is free, they said its not free, and I said well you said you only charging me for one letter - so it either costs £10 to produce a letter or it doesnt which is it you cant charge for one letter saying it cost £10 to produce and send the other for nothing!

 

Erm ERm um...... ha ha I love winding these begas up!!

no replies to some of my CCA request but time is up - including Welcome, they say they will produce list of transactions but no reply to the request for a copy of the original agreement, by the way, do they need to produce the original one from the car finance before I settled it with a new loan with them (the one secured on the home), or just the latest one?

 

any advice please:)

Welcome are a funny bunch as well as their dealers. I had a run in and it cost their dealers dear.

Not sure if they have to by law but every refinance I did I took the agreement with me. If you have already refinanced they can say you did see it and if they cant produce it now they will say its been misslaid since. They crafty bunch this Not Welcome lot.

regarding the amount for the car and the account i would think it is finished and now only comes under your mortage.

Hi, I really need to get my spreadsheet done and send my prelim to Welcome, I have all my info (only photocopies of forms they have filled in about the agreements NOT the actual loan agreement form which should be a long form with all their details, cca reg stuff as they have on normal loan application forms), does this mean they have not produced the originals (or copies) and if so what is my position because I am still paying them monthly at present??

 

any advice appreciated.

 

I feel I can work out all the penalty charges and send a prelim or

assume the agreements are unenforceable because of the paperwork scenario or

do nothing and carry on paying or

cancel the dds I am paying re: unenforceable (relunctant to do this as do not want to put the boot on the other foot!)

A while back about 7 odd years ago. I was involved with them. I recieved a phonecall from them to say that i had applied for a car through their agents and so. Isaid i was unemployed and they said we will get our dealer to phone you. My car then had a few problems. Anyway the dealer phoned and i explained that i was on is and he turned around and said you have a high credit score we can give you a car right now. so itrundled off with my paperwork and my px with its mot. they accepted and i signed etc. Only to be sold a writeoff vehicle reg p457 *** which was a escort. Regardless i also found out that the dealers had also got me to sign to say that iwas working and was not on income support. I had the car around for 4 weeks when i found this out. anyway welcome turned around and told me to return their vehicle to the dealer and to collect my part exchange. i never got the px back and welcome tried to drag it through court. Only thing i sent the log book back marked as vehicle scrapped which all the relevant agencies took notice of. Of course by the time the dealers found out it had already been 3 months. they lost big time i think approx to the tune of £4500 i think.

hello Bailiffchaser, thats very interesting and I am glad you got it sorted out in the end. I have a thread of my own on this maybelline v welcome, I realise I need to do some more homework, reread the regs on consumer credit agreements to feel totally confident about my next move but my so far informed guess is that their documents without any signature of mine on them are meaningless. maybe someone will come back to this to say otherwise? best wishes:)

As long as the cars log book is with you. you can do what you want with it. i did what i wanted and neither gained but know the other side lost heavily. If your car is taken you can have the last laugh.

Just a quick note to say I also had a car from Welcome... At the time I didn't know better!

 

Anyway, my car I found out (after taking it to a proper garage afterwards) actually had a faulty/dangerous shock absorber, and binding brakes (that melted my wheel trims and could have easily caused blowouts/death on the motorway).

 

He recommended I take them to court for attempted murder, it was that bad.

 

Three months of excuses continued, head offices PA was ill, left, got caught up in paperwork, needed escalating, etc etc etc. Finally they offered to fix it all. I refused, and demanded I got it fixed at my garage and sent them the bill.

 

Touch wood, not much else has gone wrong with it since then.

anarchist, that must have been terrifying, I certainly spent alot of money on the car I had and in the end had it scrapped! I cant exactly remember what the problem was but it kept binding, wouldnt drive straight, I kept getting the tracking and brakes re done but it did not help, other things needed doing also, it seemed it always in the garage.

 

bringing up to date on my claim, I have superceding copy document secured against my home, which shows all the figures from the previous agreements and the insurances I did not agree to, I still do not understand their statement information. Apparently they have to supply all the agreements, if I ask for them and have done so, they have confirmed they have sent all they have, front sheets for the earlier years back to 99 and the latter I have mentioned.

Hello - I just wondered if anyone knew of he next step for me in getting Welcome Car Finance to County Court. I have filled in an N1 form but cannot afford court costs at mo or solicitors fees (the car I got from them was for my driving school and it broke down the day after). I have had to hire another car and so am paying for 2 cars so I can keep working. Anyone? HELP!!! What a terrible company

katiewatey can you fill in the financial means form at the court, they should give you one or send you one to state how and why you cannot affor the fees, they should suggest a smaller sum or you might be exempt? try to get legal aid by looking at their website and use the online tool to see if you qualify.
