Several Years ago i took out a credit card with the LLoydstsb to which i got into debt and was unable to pay it back.

I made an agreement to make a payment to them every month, which i have now been paying for the last few years.

About Twelve months ago, the LLoydstsb sent a form to me, offering me another credit card and all i had to do was sign the form.

This was just to much of a temptation as i was really short of cash at that time. Stupid me i know! and now i am having trouble with this card now. Although i know i am responsible for my own actions, i do think if they had not sent me this card knowing that i had already had a card suspended due to credit difficulty`s, I would not be in this mess.

Can you give more details,was the old card account closed when they offered a new one ?

What was the original arrears and how much arrears were on the old card when they offered the new card?

How was the application/offer for the new card made ?

Yes! the Card account was closed, I owed about £3400 on the old card when i was offered the new card.I was sent a form to fill in asking for all my income details so they could work out how much i could afford to pay them each month. The new card came as an application already made out to me and all i had to do was sign it.

Yes! the Card account was closed, I owed about £3400 on the old card when i was offered the new card.I was sent a form to fill in asking for all my income details so they could work out how much i could afford to pay them each month. The new card came as an application already made out to me and all i had to do was sign it.

Sounds like irresponsible lending practices to me, as you still owed on your previous account they clearly have not fulfilled a clear part of the OFT guidlines on irresponsible lending. That being too - Make a reasonable assessment of whether a borrower can afford to make repayments in a sustainable manner;

 

Your previous record and current outstanding debt shows that you can not afford to make repayments on any second account whilst still paying the previous outstanding balance.

 

I'll have a look and see if i can find any thing that you can throw at lloydstsb, and get back to you with it.

 

Additional information:

 

Ok ive had a quick look, there is no legalisation about this other then the OFT's guidlance on irresponsible lending, however Lloyds do have an Irresponsible Lending Department in Bristol (Do not know the address) that deals with complaints of such practices. So i would suggest that you write a complaint detailing why it was irresonsible of them to have offered you another credit card when it was clear from the fact you still owed debt on a previous one with them, and as such it was clear you could not afford the repayments on the new one prior to them offering it to you. Point out that under OFT guidance to creditors on irresponsible lending it is the creditor that has a duty to ensure you can afford the repayments, something your record would have shown that you could not.

 

Also write to OFT explaining the issue too also contact Which as they can support you all the way with this and provide you expert advice and a free 15 mins advice from a solicitor.

 

P.s forgot to mention, if you do not receive a satisfactory response from them within 8-10 weeks, from the date of your letter of complaint, i would then suggest going to the financial ombudsman with your complaint. But not before 10- weeks, as you must allow atleast 8-10 weeks for the bank to deal with your complaint before proceeding to the ombudsman, although you may contact them on the phone for advice where they will give you a case number which you can put on your letter to them. If the ombudsman upholds your complaint, they may well order the debt on the second card to be written off or award you compensation, but dont hold me to that.
